1.1 A bill for an act 1.2 relating to capital improvements; authorizing spending 1.3 to acquire and better public land and buildings and 1.4 other public improvements of a capital nature with 1.5 certain conditions; authorizing sale of state bonds; 1.6 appropriating money. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. [CAPITAL IMPROVEMENT APPROPRIATIONS.] 1.9 The sums in the column under "APPROPRIATIONS" are 1.10 appropriated from the bond proceeds fund, or another named fund, 1.11 to the state agencies or officials indicated, to be spent for 1.12 public purposes. Appropriations of bond proceeds must be spent 1.13 as authorized by the Minnesota Constitution, article XI, section 1.14 5, paragraph (a), to acquire and better public land and 1.15 buildings and other public improvements of a capital nature, or 1.16 as authorized by article XI, section 5, paragraphs (b) to (j), 1.17 or article XIV. UNIVERSITY OF MINNESOTA 2.22 Subdivision 1. To the board of regents 2.23 of the University of Minnesota for the 2.24 purposes specified in this section 48,308,000 2.25 Subd. 2. Twin Cities - Minneapolis 2.26 (a) Jones Hall 8,000,000 2.27 To renovate Jones Hall on the 2.28 Minneapolis campus. 2.29 The board of regents may use the 2.30 single-phase design-build method 2.31 described in Minnesota Statutes, 2.32 section 16C.31, subdivision 6, 2.33 paragraph (c), to implement this 2.34 project. 2.35 (b) Translational Research Facility 24,700,000 2.36 To design, construct, furnish, and 2.37 equip the Translational Research 2.38 Facility, an addition to the Lyons 2.39 Research Lab building on the 2.40 Minneapolis campus. 2.41 This appropriation is not available 2.42 until the commissioner of finance has 2.43 determined that at least $12,300,000 2.44 has been committed from nonstate 3.1 sources. 3.2 The board of regents may use the 3.3 two-phase design-build method described 3.4 in Minnesota Statutes, section 16C.31, 3.5 to implement this project. 3.6 (c) Teaching and Technology Center 3,000,000 3.7 To predesign and design a teaching and 3.8 technology center for the Institute of 3.9 Technology. 3.10 Subd. 3. Twin Cities - St. Paul 3.11 Veterinary Diagnostic Laboratory 1,500,000 3.12 To renovate and upgrade the veterinary 3.13 diagnostic laboratory to provide 3.14 additional laboratory space for a 3.15 veterinary molecular diagnostic 3.16 laboratory. The renovation and upgrade 3.17 must include space for molecular 3.18 diagnostic testing for paratuberculosis 3.19 (Johne's disease), porcine reproductive 3.20 and respiratory syndrome virus in 3.21 swine, avian pneumovirus in turkeys, 3.22 bovine mastitis, and emerging and 3.23 foreign animal diseases. 3.24 Subd. 4. Morris 8,600,000 3.25 To design, renovate, furnish, and equip 3.26 the social science building to correct 3.27 building code deficiencies, remodel the 3.28 interior, install new windows, upgrade 3.29 the building's mechanical and 3.30 electrical systems, replace the roof, 3.31 and construct an addition over the 3.32 existing auditorium wing to create 3.33 space for faculty offices, and to 3.34 install fire protection systems in 3.35 three student housing facilities. 3.36 This appropriation is not available 3.37 until the commissioner of finance has 3.38 determined that at least $400,000 has 3.39 been committed from nonstate sources. 3.40 Subd. 5. Research and Outreach 3.41 Centers 2,508,000 3.42 To acquire land and design, construct, 3.43 furnish and equip facilities at 3.44 research and outreach centers. 3.45 Projects funded by this appropriation 3.46 include: 3.47 (1) research laboratory and office 3.48 space at the Northwest ROC at 3.49 Crookston; 3.50 (2) an addition to the aspen/larch 3.51 genetics laboratory at the North 3.52 Central ROC at Grand Rapids and 3.53 acquisition of land for the development 3.54 of two test planting sites to conduct 3.55 research on fast growing trees; 3.56 (3) an addition to the administration 3.57 building at the Southern ROC at Waseca; 3.58 and 4.1 (4) of this amount, $70,000 is to 4.2 construct an environmentally friendly 4.3 swine farrowing demonstration facility 4.4 at the West Central ROC, subject to 4.5 Minnesota Statutes, section 16A.695. 4.6 Sec. 3. MINNESOTA STATE COLLEGES AND 4.7 UNIVERSITIES 4.8 Subdivision 1. To the board of trustees 4.9 of the Minnesota state colleges and 4.10 universities for the purposes specified in 4.11 this section 50,716,000 4.12 Subd. 2. Bemidji State University 1,000,000 4.13 To design the colocation of the 4.14 emerging technologies and health care 4.15 programs of Bemidji state university 4.16 and Northwest technical college. 4.17 Subd. 3. Dakota Technical College 500,000 4.18 To design the renovation of the west 4.19 side of the main campus facility to 4.20 create an information technology and 4.21 telecommunications center of excellence 4.22 and an integrated library and library 4.23 information technology center. 4.24 Subd. 4. Fergus Falls 4.25 Community College 760,000 4.26 To design, construct, furnish, and 4.27 equip an expansion of the existing 4.28 maintenance shop. 4.29 To design an addition to link 4.30 Administration and Fine Arts to provide 4.31 a one-stop student service shop, smart 4.32 classrooms, open computer laboratories; 4.33 design renovation to provide space for 4.34 technology support next to the library; 4.35 and design asset preservation work. 4.36 Subd. 5. Hennepin Technical College 2,000,000 4.37 To design, renovate, furnish, and equip 4.38 existing space at the Brooklyn Park and 4.39 Eden Prairie campuses. 4.40 Subd. 6. Inver Hills Community 4.41 College 500,000 4.42 To design renovation of existing space 4.43 and construction of an addition to 4.44 create a one-stop student services 4.45 shop; enlarge and colocate central 4.46 services, the bookstore, and a new 4.47 loading dock; upgrade mechanical 4.48 systems; and provide a welcoming front 4.49 door and help desk for the campus. 4.50 Subd. 7. Lake Superior Community 4.51 and Technical College 700,000 4.52 To design a student center addition to 4.53 house a consolidated system of student 4.54 services, smart classrooms, and open 4.55 laboratories. 5.1 Subd. 8. Minnesota State University - 5.2 Mankato - Phase 3 8,400,000 5.3 To renovate, furnish, and equip Otto 5.4 Arena and adjacent areas to provide a 5.5 student fitness facility. 5.6 Subd. 9. Minnesota West Community and 5.7 Technical College at Worthington 6,300,000 5.8 To design, construct, furnish, and 5.9 equip a one-stop student services shop 5.10 and welcome counter addition. 5.11 To design, renovate, furnish, and equip 5.12 two science laboratories and associated 5.13 preparation, storage, and office spaces. 5.14 To design, renovate, furnish, and equip 5.15 consolidated nursing and allied health 5.16 department and other classroom spaces. 5.17 Subd. 10. Northeast Higher Education 5.18 District - Virginia 5,496,000 5.19 To design, renovate, and equip science 5.20 laboratories, a learning resource 5.21 center, a student commons, and 5.22 classrooms, including technology 5.23 equipped classrooms, and construct new 5.24 loading dock and driveway. 5.25 Subd. 11. Northwest Technical College - 5.26 Moorhead Campus 400,000 5.27 To design the renovation of existing 5.28 facilities and design new facilities 5.29 for an allied health and applied 5.30 technology laboratory and support 5.31 facilities. 5.32 Subd. 12. Ridgewater Community and 5.33 Technical College 2,880,000 5.34 To design, renovate, furnish, and equip 5.35 existing chemistry, physics, and 5.36 biology laboratories and convert a 5.37 classroom into a geology laboratory on 5.38 the Willmar campus. 5.39 To design, renovate, furnish, and equip 5.40 interior space to convert obsolete 5.41 applied laboratory space on the 5.42 Hutchinson campus into chemistry, 5.43 physics, and biology laboratories. 5.44 Subd. 13. South Central Technical 5.45 College 300,000 5.46 To design renovation of teaching 5.47 laboratories at the North Mankato 5.48 campus and design asset preservation at 5.49 the Faribault campus. 5.50 Subd. 14. Southeast Technical 5.51 College 580,000 5.52 To design, renovate, furnish, and equip 5.53 a one-stop student services area and 5.54 workforce center entrance at Winona. 6.1 To design the renovation of a one-stop 6.2 student services areas and student 6.3 center entrance at Red Wing. 6.4 Subd. 15. Southwest State University 9,200,000 6.5 To renovate and reconfigure, furnish, 6.6 and equip the library and construct a 6.7 new entrance. 6.8 Subd. 16. St. Cloud State University 10,000,000 6.9 To design the renovation of Centennial 6.10 Hall and to renovate, furnish, and 6.11 equip the renovation of Centennial Hall 6.12 and its conversion from library to 6.13 classroom use and to design the code 6.14 correction and renovation of Riverview 6.15 Hall. This appropriation may also be 6.16 used for design of the renovation of 6.17 Brown Hall and Eastman Hall. 6.18 Subd. 17. St. Cloud Technical College 700,000 6.19 To design the construction of a 6.20 multistory building connected to the 6.21 existing facility and the renovation of 6.22 part of "G" wing. 6.23 Subd. 18. Land Acquisition 1,000,000 6.24 To acquire real property near the state 6.25 college and university campuses from 6.26 willing sellers. 6.27 Sec. 4. CHILDREN, FAMILIES, AND LEARNING 6.28 Subdivision 1. To the commissioner of 6.29 children, families, and learning for the 6.30 purposes specified in this section 22,500,000 6.31 Subd. 2. Southwest Integration 6.32 Magnet Schools 1,000,000 6.33 For a grant in accordance with the 6.34 metropolitan magnet school grant 6.35 program under Minnesota Statutes, 6.36 section 124D.88, to the West Metro 6.37 Education Program joint powers board to 6.38 acquire land, prepare a site, 6.39 predesign, and design a new building 6.40 for the Southwest Integration Magnet 6.41 School in St. Louis Park, to serve a 6.42 population of approximately 500 6.43 kindergarten through grade 8 students. 6.44 Subd. 3. Library Access Grants 1,000,000 6.45 For library access grants under 6.46 Minnesota Statutes, section 134.45, to 6.47 remove architectural barriers from a 6.48 library building or site. 6.49 Subd. 4. Minnesota 6.50 Planetarium 9,500,000 6.51 For a grant to the city of Minneapolis 6.52 to design, construct, furnish, and 6.53 equip a new Minnesota planetarium, 6.54 subject to Minnesota Statutes, section 6.55 16A.695. 7.1 This appropriation is not available 7.2 until the commissioner has determined 7.3 that at least an equal amount has been 7.4 committed from nonstate sources. The 7.5 proportional share of the in-kind 7.6 contributions for the planetarium of 7.7 land, parking facilities, skyways, and 7.8 municipal infrastructure for the 7.9 planetarium may be counted as part of 7.10 the match. The proportional share of 7.11 the costs to the city of constructing 7.12 mechanical and electrical systems, 7.13 common areas, service areas, freight 7.14 elevators, and walls and roofs for the 7.15 planetarium shared with the Minneapolis 7.16 library and included in the costs of 7.17 constructing the library may also be 7.18 counted as part of the match. 7.19 The legislature intends not to 7.20 appropriate additional money to 7.21 construct the planetarium until at 7.22 least $4,000,000 in cash contributions 7.23 have been committed to the project from 7.24 other than state or local government 7.25 funds. 7.26 Subd. 5. Asian Community Center 1,000,000 7.27 For a grant to the city of St. Paul to 7.28 design, construct, furnish, and equip 7.29 an Asian community center, subject to 7.30 Minnesota Statutes, section 16A.695. 7.31 This appropriation is not available 7.32 until the commissioner has determined 7.33 that at least an equal amount has been 7.34 committed from nonstate sources. 7.35 Subd. 6. Colin Powell Youth 7.36 Leadership Center 700,000 7.37 For a grant to Hennepin county to 7.38 acquire land for and to design, 7.39 construct, furnish, and equip the Colin 7.40 Powell Youth Leadership center in 7.41 Minneapolis, subject to Minnesota 7.42 Statutes, section 16A.695. The center 7.43 will include a national guard drill 7.44 area, an education wing, including a 7.45 computer lab, a multipurpose arts 7.46 facility, a community education space, 7.47 a nutrition education and cooking 7.48 skills work-preparation area, and four 7.49 new basketball courts. 7.50 This appropriation is not available 7.51 until the commissioner has determined 7.52 that at least an equal amount has been 7.53 committed from nonstate sources. 7.54 Subd. 7. Neighborhood 7.55 House/El Rio Vista 1,800,000 7.56 For a grant to the city of St. Paul to 7.57 acquire land for and to design, 7.58 construct, furnish, and equip an 7.59 expansion of Neighborhood House/El Rio 7.60 Vista, subject to Minnesota Statutes, 7.61 section 16A.695. 8.1 This appropriation is not available 8.2 until the commissioner has determined 8.3 that at least an equal amount has been 8.4 committed from nonstate sources. 8.5 Subd. 8. Trollwood 8.6 Performing Arts School 5,500,000 8.7 For a grant to the city of Moorhead to 8.8 acquire land for and to design, 8.9 construct, furnish, and equip Trollwood 8.10 Arts Village in the city of Moorhead, 8.11 subject to Minnesota Statutes, section 8.12 16A.695. Trollwood must be available 8.13 to regional arts groups. 8.14 This appropriation is not available 8.15 until the commissioner has determined 8.16 that at least an equal amount has been 8.17 committed from nonstate sources. 8.18 Subd. 9. Early Childhood Learning 8.19 and Child Protection Facilities 2,000,000 8.20 For grants to construct or rehabilitate 8.21 facilities for programs under Minnesota 8.22 Statutes, section 119A.45. 8.23 Sec. 5. NATURAL RESOURCES 8.24 Subdivision 1. To the 8.25 commissioner of natural resources 8.26 for the purposes specified 8.27 in this section 32,162,000 8.28 Subd. 2. State Park Initiative 4,500,000 8.29 For building, utility, and natural 8.30 resource projects within the Minnesota 8.31 state park system according to the 8.32 management plan required in Minnesota 8.33 Statutes, chapter 86A, as follows: 8.34 (1) to design, renovate, construct, 8.35 furnish, and equip state park 8.36 buildings; and 8.37 (2) to design, renovate, furnish, and 8.38 equip capital facilities at state 8.39 parks, state recreation areas, and 8.40 forest recreation areas, including, but 8.41 not limited to, roads, trails, bridges, 8.42 campgrounds, and utility systems. 8.43 $1,600,000 is for improvements and 8.44 betterments of a capital nature to 8.45 develop the Big Bog state recreation 8.46 area, including constructing, 8.47 furnishing, and equipping a visitors 8.48 center. 8.49 $2,900,000 is for improvements and 8.50 betterments of a capital nature to 8.51 develop the Red River state recreation 8.52 area, including construction of a 8.53 visitor's center. 8.54 Subd. 3. State Park and Recreation Area 8.55 Acquisition 3,000,000 8.56 For acquisition of land under Minnesota 9.1 Statutes, section 86A.05, subdivision 9.2 2, from willing sellers of private 9.3 lands within state park and recreation 9.4 area boundaries established by law. 9.5 Subd. 4. Metro Regional Park Acquisition 9.6 and Betterment 2,700,000 9.7 For a grant to the metropolitan council 9.8 to complete renovation of the Como Park 9.9 conservatory under phase 2. The 9.10 project must include renovation of the 9.11 fern room and construction of a bonsai 9.12 collection space, an orchid growing and 9.13 display house, and a children's 9.14 activity zone, as well as corridors and 9.15 connections to the education resource 9.16 building. 9.17 Subd. 5. Regional Parks: 9.18 Greater Minnesota 4,000,000 9.19 For grants to public regional parks 9.20 organizations located outside the 9.21 metropolitan area as defined in 9.22 Minnesota Statutes, section 473.121, 9.23 subdivision 2, to acquire land, design, 9.24 and construct and redevelop regional 9.25 parks and trails, open space, and 9.26 recreational facilities. The 9.27 improvements must be of a capital 9.28 nature. A greater Minnesota regional 9.29 parks organization with a project 9.30 previously funded through the regional 9.31 parks program, whether with bond funds 9.32 or other funds, at less than the total 9.33 eligible amount may reapply for the 9.34 total eligible amount from this 9.35 appropriation. If it is awarded, the 9.36 organization must return the original 9.37 grant award. Each $3 of state grants 9.38 must be matched by $2 of nonstate funds. 9.39 Subd. 6. Reforestation 1,500,000 9.40 For improvements authorized under the 9.41 Minnesota Constitution, article XI, 9.42 section 5, clause (f). To increase 9.43 reforestation activities to meet the 9.44 reforestation requirements of Minnesota 9.45 Statutes, section 89.002, subdivision 9.46 2, including planting, seeding, site 9.47 preparation, purchasing tree seeds and 9.48 seedlings, improving forest stands, and 9.49 protecting plantations. 9.50 Subd. 7. State Forest Land Acquisition 500,000 9.51 To acquire private lands from willing 9.52 sellers within established boundaries 9.53 of state forests throughout the state 9.54 under Minnesota Statutes, section 9.55 86A.05, subdivision 7. 9.56 Subd. 8. State Trail Acquisition 9.57 and Development 2,750,000 9.58 To acquire, develop, and renovate state 9.59 trails as specified in Minnesota 9.60 Statutes, section 85.015. 10.1 $725,000 is for the Gitchi-Gami trail. 10.2 $450,000 is for the Shooting Star trail. 10.3 $600,000 is for a grant to the city of 10.4 Austin to acquire land for the Blazing 10.5 Star trail. 10.6 $475,000 is for the Goodhue Pioneer 10.7 trail. 10.8 $500,000 is to connect the portions of 10.9 the Paul Bunyan trail in the city of 10.10 Bemidji, including constructing an 10.11 underpass. This appropriation is not 10.12 available until the commissioner has 10.13 determined that an equal amount has 10.14 been committed by the city of Bemidji. 10.15 Subd. 9. Trail Connections 1,857,000 10.16 For matching grants under Minnesota 10.17 Statutes, section 85.019, subdivision 10.18 4c, including a grant to the city of 10.19 St. Louis Park to design and construct 10.20 a grade separated pedestrian and 10.21 regional trail crossing over CSAH No. 10.22 25/Trunk Highway 7 at Trunk Highway 100 10.23 to connect the Cedar Lake Regional 10.24 Trail and the Southwest LRT Regional 10.25 Trail, a grant to the city of New Ulm 10.26 to connect the city trail to Flandrau 10.27 state park, and a grant to Stearns 10.28 county for the Lake Koronis trail. 10.29 The commissioner shall determine other 10.30 project priorities as appropriate based 10.31 on need. 10.32 Subd. 10. Metro Greenways and Natural 10.33 Areas 1,000,000 10.34 To provide grants to local units of 10.35 government for acquisition or 10.36 betterment of greenways and natural 10.37 areas in the metro region and to 10.38 acquire greenways and natural areas in 10.39 the metro region through the purchase 10.40 of conservation easements or fee 10.41 titles. The commissioner shall 10.42 determine the project priorities and 10.43 shall consult with representatives of 10.44 local units of government, nonprofit 10.45 organizations, and other interested 10.46 parties. 10.47 Subd. 11. Lewis and Clark 10.48 Rural Water System 180,000 10.49 This appropriation is from the general 10.50 fund. 10.51 For a grant to the Lewis and Clark 10.52 joint powers board to acquire land for, 10.53 and to predesign, design, construct, 10.54 furnish, and equip, a rural water 10.55 system to serve southwestern 10.56 Minnesota. This appropriation is 10.57 available when matched by $8 of federal 10.58 money and $1 of local money for each $1 10.59 of state money. 11.1 Subd. 12. Red Rock Rural 11.2 Water System 125,000 11.3 For a grant to the Red Rock rural water 11.4 system to acquire land, predesign, 11.5 design, construct, and equip the 11.6 southwest Minnesota regional water 11.7 supply project. This appropriation is 11.8 not available until at least an equal 11.9 amount of nonstate money has been 11.10 committed to the project. 11.11 Subd. 13. Dam Improvements 1,150,000 11.12 To renovate or remove publicly owned 11.13 dams. 11.14 Of this amount, up to $100,000 is for a 11.15 grant to Blue Earth county for 11.16 renovation of the Rapidan dam. This 11.17 grant is not available until at least 11.18 an equal amount is committed to the 11.19 project from nonstate sources. 11.20 Up to $1,050,000 is for a grant to the 11.21 city of Crookston for phases 2 and 3 of 11.22 the Red Lake River restoration and 11.23 habitat improvement project. 11.24 Subd. 14. Stream Protection 11.25 and Restoration 1,000,000 11.26 For the design and implementation of 11.27 stream restoration projects that employ 11.28 natural channel design principles. 11.29 Subd. 15. Water Access 11.30 Acquisition and Development 1,500,000 11.31 For public water access acquisition, 11.32 construction, and renovation to capital 11.33 projects on lakes and rivers, including 11.34 construction of a fishing pier at Blue 11.35 Mound state park and other water access 11.36 through the provision of fishing piers 11.37 and shoreline access under Minnesota 11.38 Statutes, section 86A.05, subdivision 9. 11.39 Subd. 16. Lake Superior 11.40 Safe Harbor 1,100,000 11.41 To complete construction of the public 11.42 access at McQuade Road on Lake Superior 11.43 in cooperation with the U.S. Army Corps 11.44 of Engineers and the joint powers board 11.45 made up of the city of Duluth, St. 11.46 Louis county, the town of Duluth, and 11.47 the town of Lakewood. 11.48 Subd. 17. Fish Hatchery 11.49 Improvements 300,000 11.50 For improvements of a capital nature to 11.51 design, construct, renovate, furnish, 11.52 and equip fish culture facilities under 11.53 Minnesota Statutes, section 97A.045, 11.54 subdivision 1. 11.55 Subd. 18. Fisheries Acquisition 11.56 and Improvement 500,000 12.1 To acquire aquatic management areas and 12.2 to make public improvements and 12.3 betterments of a capital nature to fish 12.4 habitat under Minnesota Statutes, 12.5 section 86A.05, subdivision 14. 12.6 Subd. 19. Scientific and Natural Area 12.7 Acquisition and Improvement 2,500,000 12.8 To acquire land for scientific and 12.9 natural areas and for development, 12.10 protection, or improvements of a 12.11 capital nature to scientific and 12.12 natural areas throughout the state 12.13 under Minnesota Statutes, sections 12.14 84.033 and 86A.05, subdivision 5. 12.15 Up to $1,500,000 is to acquire and make 12.16 improvements of a capital nature to 12.17 restore, and develop the Seminary fen 12.18 in the Assumption creek watershed in 12.19 Carver county. The commissioner shall 12.20 manage the Seminary fen in accordance 12.21 with Minnesota Statutes, chapter 86A, 12.22 in part as an aquatic management area, 12.23 in part as a scientific and natural 12.24 area, and in part as a wildlife 12.25 management area. 12.26 Subd. 20. Natural and Scenic Area 12.27 Land Acquisition Grants 1,000,000 12.28 For matching grants to local units of 12.29 government to acquire and better local 12.30 natural and scenic areas under 12.31 Minnesota Statutes, section 85.019, 12.32 subdivision 4a. The commissioner shall 12.33 determine project priorities as 12.34 appropriate based on project 12.35 significance and need. 12.36 Subd. 21. Native Prairie 12.37 Bank Easements 1,000,000 12.38 For acquisition of native prairie bank 12.39 easements under Minnesota Statutes, 12.40 section 84.96. 12.41 Sec. 6. OFFICE OF ENVIRONMENTAL ASSISTANCE 3,600,000 12.42 To the office of environmental 12.43 assistance for grants under the solid 12.44 waste capital assistance grants program 12.45 under Minnesota Statutes, section 12.46 115A.54. Grants from this 12.47 appropriation must be awarded to 12.48 applicants whose applications were on 12.49 file with the office before January 1, 12.50 2002. The office must give priority 12.51 for grants to projects that expand 12.52 processing capacity. 12.53 Sec. 7. BOARD OF WATER AND SOIL RESOURCES 12.54 Subdivision 1. To the board 12.55 of water and soil resources for the 12.56 purposes specified in this section 8,250,000 12.57 Subd. 2. RIM Conservation 12.58 Easements 2,000,000 13.1 This appropriation is to acquire 13.2 conservation easements from landowners 13.3 on marginal lands to protect soil and 13.4 water quality and to support fish and 13.5 wildlife habitat as provided in 13.6 Minnesota Statutes, section 103F.515. 13.7 Subd. 3. Shoreland Protection 13.8 Program 750,000 13.9 To acquire conservation easements in 13.10 environmentally sensitive lake and 13.11 river shoreland areas from private 13.12 landowners. The board may award grants 13.13 to local soil and water conservation 13.14 districts and participating local units 13.15 of government to accomplish the 13.16 purposes of this program, in accordance 13.17 with Minnesota Statutes, section 13.18 103F.225. 13.19 $100,000 of this amount may be used to 13.20 administer the program. 13.21 Subd. 4. Wetland Replacement 13.22 Due to Public Road Projects 2,700,000 13.23 To acquire land for wetlands or restore 13.24 wetlands to be used to replace wetlands 13.25 drained or filled as a result of the 13.26 repair, maintenance, or rehabilitation 13.27 of existing public roads as required by 13.28 Minnesota Statutes, section 103G.222, 13.29 subdivision 1, paragraph (l). 13.30 The purchase price paid for acquisition 13.31 of land, fee, or perpetual easement 13.32 must be the fair market value as 13.33 determined by the board. The board may 13.34 enter into agreements with the federal 13.35 government, other state agencies, 13.36 political subdivisions, and nonprofit 13.37 organizations or fee owners to acquire 13.38 land and restore and create wetlands 13.39 and to acquire existing wetland banking 13.40 credits with money provided by this 13.41 appropriation. Port Development Assistance 3,000,000 17.9 For grants under Minnesota Statutes, 17.10 sections 457A.01 to 457A.06. Any 17.11 improvements made with the proceeds of 17.12 these grants must be publicly owned. 17.13 Subd. 6. Freight Access Improvements 7,000,000 17.14 Each grant is not available until the 17.15 commissioner has determined that at 17.16 least an equal amount has been 17.17 committed from any combination of 17.18 municipal state-aid money and nonstate 17.19 sources. The state share may be 17.20 allocated to any one or more of the 17.21 project elements, with the nonstate 17.22 money used to complete any elements not 17.23 completed with state money. 17.24 $3,500,000 is for a grant to the city 17.25 of Savage to improve highway access to 17.26 the ports of Savage. The improvements 17.27 may include local frontage roads, 17.28 access consolidations, road closures, 17.29 new signals, and acceleration and 17.30 deceleration lanes. 17.31 $3,500,000 is for a grant to the port 17.32 authority of Winona to construct 17.33 intermodal improvements at the Winona 17.34 harbor. The improvements may include 17.35 commercial harbor dredging, overpass 17.36 construction, street widening, signal 17.37 installation, and intersection 17.38 reconstruction. 17.39 Subd. 7. Greater Minnesota 17.40 Transit Facilities 2,000,000 17.41 For capital assistance for greater 17.42 Minnesota transit systems to be used 17.43 for transit capital facilities. Money 17.44 from this appropriation may be used to 17.45 pay up to 80 percent of the nonfederal 17.46 share of these facilities. 17.47 Subd. 8. Radio Communications 17.48 Statewide System 13,000,000 17.49 To design and construct the statewide 17.50 public safety radio communications 17.51 system infrastructure, coordinating it 17.52 with other state and local units of 17.53 government, and extending it to all of 17.54 the southeast district of the state 17.55 patrol, and into the central district 17.56 of the state patrol, with first 17.57 priority given to development in 17.58 Stearns, Sherburne, Benton, and Wright 17.59 counties, subject to the requirements 17.60 of Minnesota Statutes, section 16A.695. 18.1 Subd. 9. Wastewater Infrastructure 20.22 Funding Program 30,600,000 20.23 $600,000 of this appropriation is from 20.24 the general fund to administer the 20.25 wastewater infrastructure program. 20.26 To the public facilities authority for 20.27 grants to eligible municipalities under 20.28 the wastewater infrastructure program 20.29 established in Minnesota Statutes, 20.30 section 446A.072. 20.31 To the greatest practical extent, the 20.32 authority should use the grants for 20.33 projects on the 2002 project priority 20.34 list in priority order to qualified 20.35 applicants that submit plans and 20.36 specifications to the pollution control 20.37 agency or receive a funding commitment 20.38 from USDA rural development before 20.39 December 1, 2004. 20.40 The pollution control agency shall 20.41 prepare amendments to Minnesota Rules, 20.42 part 7077.0115, for ranking wastewater 20.43 projects on the project priority list 20.44 that take into account issues such as, 20.45 but not limited to, the age and 20.46 condition of existing wastewater 20.47 treatment systems, issues associated 20.48 with growth, and the effects on 20.49 municipalities when a moratorium on new 20.50 sewer connections is imposed. New Brighton 23.21 Caboose and History Center 100,000 23.22 This appropriation is from the general 23.23 fund. 23.24 For a grant to the New Brighton area 23.25 historical society to renovate its 23.26 caboose and history center in Long Lake 23.27 Regional Park. 23.28 This appropriation is not available 23.29 until the commissioner of finance has 23.30 determined that at least an equal 23.31 amount has been committed from nonstate 23.32 sources. 23.33 Subd. 5. Pipestone County Museum 125,000 23.34 For a grant to the city of Pipestone to 23.35 design and construct an external shaft 23.36 and hoist way and install an elevator 23.37 adjacent to the Pipestone County Museum 23.38 and renovate a third-floor area to be 23.39 used as a community room and a museum 23.40 programs room, subject to Minnesota 23.41 Statutes, section 16A.695. 23.42 This appropriation is not available 23.43 until the commissioner of finance has 23.44 determined that at least an equal 23.45 amount has been committed from nonstate 23.46 sources. 23.47 Sec. 22. BOND SALE EXPENSES 332,000 23.48 To the commissioner of finance for bond 23.49 sale expenses under Minnesota Statutes, 23.50 section 16A.641, subdivision 8. This 23.51 appropriation is from the bond proceeds 23.52 fund. 23.53 Sec. 23. [APPROPRIATION CANCELED.] 23.54 $332,000 of the appropriation for bond sales expenses in 24.1 Laws 2002, chapter 393, section 29, is canceled to the bond 24.2 proceeds fund. 24.3 Sec. 24. [BOND SALE AUTHORIZATION.] 24.4 To provide the money appropriated in this act from the bond 24.5 proceeds fund, the commissioner of finance shall sell and issue 24.6 bonds of the state in an amount up to $353,255,000 in the 24.7 manner, upon the terms, and with the effect prescribed by 24.8 Minnesota Statutes, sections 16A.631 to 16A.675, and by the 24.9 Minnesota Constitution, article XI, sections 4 to 7. 24.10 Sec. 25. [2002 BOND SALE AUTHORIZATION REDUCED.] 24.11 The bond sale authorization in Laws 2002, chapter 393, 24.12 section 30, subdivision 1, is reduced by $353,255,000. 24.13 Sec. 26. [DEBT SERVICE AND CONTINGENCY FUNDS; CERTAIN 24.14 EDUCATION PROJECTS.] 24.15 Laws 2002, chapter 393, sections 2, subdivisions 10 and 11; 24.16 and 3, subdivisions 29 and 30, apply to projects in this act to 24.17 the same extent they would have applied to those projects if 24.18 they had not been vetoed and thus not finally enacted as a part 24.19 of Laws 2002, chapter 393. 24.20 Sec. 27. [EFFECTIVE DATE.] 24.21 Except as otherwise expressly provided in this act, this 24.22 act is effective the day after its final enactment.
