A bill for an act
relating to public safety; establishing training for peace officers in de-escalation
techniques; appropriating money; amending Minnesota Statutes 2016, section
626.8452, subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2016, section 626.8452, subdivision 2, is amended to read:
Subd. 2.
Deadly force and firearms use; initial instruction.
Beginning January 1,
1992, the head of every local and state law enforcement agency shall provide instruction
on the use of force, deadly force, deleted text begin anddeleted text end the use of firearmsnew text begin , and the use of crisis de-escalation
techniques to avoid the use of deadly forcenew text end to every peace officer and part-time peace officer
newly appointed by or beginning employment with the agency. This instruction must occur
before the agency head issues a firearm to the officer or otherwise authorizes the officer to
carry a firearm in the course of employment. The instruction must be based on the agency's
written policy required in subdivision 1 and on the instructional materials required by the
board for peace officer and part-time peace officer licensure.

$....... in fiscal year 2018 is appropriated from the general fund to the commissioner of
public safety to be spent for training peace officers in the use of crisis de-escalation
techniques. The commissioner must consult with the director of the Peace Officers Training
and Standards Board, and may consult with any other state or local governmental official
or nongovernmental authority the commissioner determines to be relevant, to include
postsecondary institutions, when selecting a service provider for this training. Among any
other criteria the commissioner may establish for the selection, the training provider must
have a demonstrated understanding of policing in culturally and racially diverse communities.
The commissioner must ensure that training opportunities provided are reasonably distributed
statewide.
