  1.1                          A bill for an act 
  1.2             relating to consumer protection; requiring child 
  1.3             protective devices in shopping carts; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 325E.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [325E.60] [SHOPPING CARTS; CHILD PROTECTIVE 
  1.7   DEVICES.] 
  1.8      Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.9   section, the following terms have the meanings given them: 
  1.10     (1) "child protective device" means a strap, device, or 
  1.11  piece of equipment designed, using reasonable engineering 
  1.12  standards, to prevent a child from falling out of a shopping 
  1.13  cart; and 
  1.14     (2) "seller" means a person who regularly sells goods at 
  1.15  retail. 
  1.16     Subd. 2.  [REQUIREMENT.] A seller that makes shopping carts 
  1.17  available for use by its customers shall make available shopping 
  1.18  carts equipped with a child protective device that is adjustable 
  1.19  and maintained in working condition so as to secure a child of 
  1.20  average size ranging in age from six months to four years.
