A bill for an act
relating to MNsure; establishing time frames within which the MNsure board of
directors, MNsure chief executive officer, and commissioner of human services
must respond to requests from members of the Legislative Oversight Committee;
amending Minnesota Statutes 2014, sections 62V.05, by adding a subdivision;
256.01, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 62V.05, is amended by adding a
subdivision to read:

new text begin Requests from Legislative Oversight Committee. new text end

new text begin If a chairperson or
at least two members of the Legislative Oversight Committee established under section
62V.11 submit to the board or the MNsure chief executive officer a request for information
or materials related to the operation or financing of MNsure, the board or chief executive
officer shall provide the requested information or materials within three business days of
receiving the request. If the board or chief executive officer is not able to provide all of the
information or materials requested within three business days, the board or chief executive
officer shall notify the person or persons who submitted the request before the end of the
third business day that an extension of five business days is necessary to respond to the
request. The board or chief executive officer may request one or more additional extensions
of five business days as necessary to respond completely to the request by, before the end
of the current extension period, notifying the person or persons who submitted the request
of the need for an additional five-day extension. Nothing in this subdivision requires the
board or chief executive officer to provide, in response to a request under this subdivision,
data that the board or chief executive officer is prohibited from sharing by other law.

Sec. 2.

Minnesota Statutes 2014, section 256.01, is amended by adding a subdivision
to read:

on the operation or financing of the MNsure system and MNsure portal as it relates to
public health care programs and public health care program enrollees, the commissioner
shall provide the requested information or materials within three business days of receiving
the request. If the commissioner is not able to provide all the information or materials
requested within three business days, the commissioner shall notify the person or persons
who submitted the request before the end of the third business day that an extension of five
business days is necessary to respond to the request. The commissioner may request one
or more additional extensions of five business days as necessary to respond completely
to the request by, before the end of the current extension period, notifying the person
or persons who submitted the request of the need for an additional five-day extension.
Nothing in this subdivision requires the commissioner to provide, in response to a request
under this subdivision, data that the commissioner is prohibited from sharing by other law.
