BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RENEWABLE QUALIFYING ELECTRIC GENERATION FACILITY
GRANT.

new text begin Definition; qualifying facility. new text end

new text begin For the purpose of this section,
"qualifying facility" means an electric generation facility with a capacity of less than 40
kilowatts that is Underwriter Laboratories (UL) approved and that generates electric
power by means of a reasonable energy source.

new text begin (a) The owner of a qualifying facility that satisfies all the
requirements for net metering of Minnesota Statutes, section 216B.164, may apply to
the commissioner of commerce for a grant of the lesser of $2,500 or 35 percent of the
cost of the facility, including installation.

new text begin (b) The commissioner shall provide grant application forms that must be used by a
grant applicant. The commissioner shall make grants only from funds appropriated for
that purpose and to the extent of those appropriations. Grants must be made to applicants
in the order of the time of receipt of a complete application.

new text begin $1,000,000 is appropriated to the commissioner of commerce from funds received
by the Department of Commerce for the state energy program from the federal American
Recovery and Reinvestment Act of 2009 (Public Law 111-5) for the purpose of making
grants under section 1.
