A bill for an act
relating to the Public Facilities Authority; requiring five percent of certain federal
funds to be used for lead service line replacement activities; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

JOBS ACT.

new text begin Use of federal funds. new text end

new text begin (a) Notwithstanding any law or rule to the contrary,
the Public Facilities Authority must disburse five percent of the federal funds received by
the state of Minnesota for lead service line replacement capitalization grants administered
by the United States Environmental Protection Agency under Public Law 117-58 for lead
service line replacement for the following activities:

new text begin (1) planning and design for lead service line infrastructure projects;

new text begin (2) developing or updating lead service line inventories, including locating and mapping
lead service lines;
new text end

new text begin (3) providing technical assistance to small water systems undertaking lead service line
inventories or construction projects; and

new text begin (4) nonroutine lead sampling conducted for reasons other than mandatory compliance
with an ordinance, law, or rule.

new text begin (b) Notwithstanding any law or rule to the contrary, the commissioner or administrative
head of the state entity with responsibility for the activities described in this paragraph must
spend two percent of the federal funds received by the state of Minnesota for lead service
line replacement capitalization grants administered by the United States Environmental
Protection Agency under Public Law 117-58 for lead service line replacement to fund state
staff and contractors to work on lead service line education and outreach, inventory, and
other associated activities.

new text begin Report. new text end

new text begin On or before January 31, 2023, and each January 31 for four years
thereafter, the Public Facilities Authority, in collaboration with any other relevant state
agency, must submit a report to the legislature that details the disbursement of funds under
this section, including the total amount spent on each of the activities described under
subdivision 1. A copy of this report must also be sent to the chairs and ranking minority
members of the legislative committees having jurisdiction over capital investment, health
finance, and environment and natural resources finance.
