A bill for an act
relating to human services; providing for community mental health programs
workforce relief emergency payments; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; COMMUNITY MENTAL HEALTH PROGRAMS
WORKFORCE RELIEF EMERGENCY PAYMENTS.

new text begin (a) $62,000,000 in fiscal year 2023 is appropriated from the American Rescue Plan state
fiscal recovery federal fund to the commissioner of human services to administer emergency
onetime payments to community mental health programs that agree to use the funds for
sustaining direct service operations and hiring and retention bonuses to hire new employees
or retain existing employees, increase employee benefits, and provide additional training
and supervision.

new text begin (b) For purposes of this section, "community mental health program" means a mental
health provider, center, clinic, program, or entity that:

new text begin (1) is operating in Minnesota and is:
new text end

new text begin (i) eligible for a rate increase under Minnesota Statutes, section 256B.763;
new text end

new text begin (ii) providing day treatment programs for children or adults; or
new text end

new text begin (iii) serving children with an emotional disorder or adults with mental illness, including
through assertive community treatment, intensive residential treatment services, adult
rehabilitative mental health services, mobile and residential crisis services, children's
therapeutic services and supports, early intensive developmental and behavioral intervention,
children's residential services, psychiatric residential treatment facilities, outpatient mental
health treatment provided by mental health professionals, community mental health center
services, certified community behavioral health clinics, intensive mental health outpatient
treatment, day treatment and treatment foster care, or mental health targeted case
management;

new text begin (2) demonstrates to the commissioner that at least 30 percent of the community mental
health program's clients are:

new text begin (i) uninsured; or
new text end

new text begin (ii) enrolled in medical assistance or MinnesotaCare;
new text end

new text begin (3) is not providing hospital inpatient services;
new text end

new text begin (4) is not providing hospital outpatient services; and
new text end

new text begin (5) is not receiving a grant under United States Code, title 42, section 254b.

new text begin (c) Onetime payments made under this section must be allocated across community
mental health programs in proportion to their mental health Medicaid and MinnesotaCare
utilization as of June 30, 2021. The commissioner must develop an expedient distribution
process in consultation with stakeholders.

new text begin (d) For the services that require cost reports for rate setting, the funding allocated under
this section is not required to be included in cost reporting to the Department of Human
Services if the funding is used for recurring expenses, unless the Centers for Medicare and
Medicaid Services or the commissioner indicate otherwise.

new text begin (e) Up to $100,000 may be used by the commissioner for administrative costs.

new text begin (f) Payment recipients must provide documentation of the use of funds through an
attestation form developed by the commissioner and may be subject to postpayment activity
audit review by the commissioner.
