A bill for an act
relating to environment; prohibiting regulation of wood-burning heaters;
amending Minnesota Statutes 2014, section 116.07, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 116.07, is amended by adding a
subdivision to read:

new text begin Wood-burning heaters. new text end

new text begin The agency shall not regulate the manufacture,
performance, or use of residential wood-burning heaters or appliances through a state
implementation plan or otherwise, unless first specifically authorized to do so by the
legislature. No rule respecting establishment or enforcement of performance standards for
residential wood-burning heaters or appliances is effective unless and until first approved
by the legislature. No employee of the state shall enforce any new rules or regulations
concerning residential wood-burning furnaces, stoves, fireplaces, or heaters.
