A bill for an act
relating to medical assistance; modifying requirements for release of notice
of potential claim; amending Minnesota Statutes 2014, section 256B.15, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 256B.15, is amended by adding a
subdivision to read:

new text begin Payment and release of notice of potential claim. new text end

new text begin (a) An individual
may provide written notice of medical assistance disenrollment to the commissioner of
human services if the individual:

new text begin (1) is 55 to 64 years of age;
new text end

new text begin (2) received medical assistance for services other than institutional services; and
new text end

new text begin (3) is eligible for medical assistance pursuant to the eligibility category established
by section 256B.056, subdivision 1a, paragraph (b), clause (1), item (v).

new text begin (b) Upon receipt of the notice of disenrollment, the commissioner shall calculate the
amount of medical assistance correctly paid on behalf of the former recipient.

new text begin (c) Within 60 days of receipt of the notice of disenrollment, the commissioner shall
provide to the former recipient in writing the amount of medical assistance correctly
paid on behalf of the former recipient and offer the recipient the opportunity to remit
this amount to the commissioner.

new text begin (d) Upon receipt of the remittance, the commissioner must fully release any notice
of potential claim or lien under subdivisions 1c, 1e, and 1f, and provide written notice to
the former recipient that the commissioner fully released the notice and the lien.
