A bill for an act
relating to human services; requiring the commissioner of human services to seek
an amendment to the budget methodology for consumer-directed community
supports.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

TO CONSUMER-DIRECTED COMMUNITY SUPPORTS BUDGET
METHODOLOGY.

new text begin By July 1, 2015, the commissioner of human services shall request from the
Centers for Medicare and Medicaid Services an amendment, if necessary, to the home
and community-based services waivers authorized under Minnesota Statutes, sections
256B.092 and 256B.49, adjusting the budget methodology for consumer-directed
community supports for individuals 21 years of age and older who have left the
school system so that they may effectively self-direct their employment and daytime
supports. The increase must be equal to the weighted average of daily employment and
daytime supports costs within each waiver for individuals accessing services other than
consumer-directed community supports. The commissioner shall consult with stakeholders
to implement this section by January 1, 2016, or upon federal approval, whichever is later.
