A bill for an act
relating to transportation; modifying particular use access to certain roadways;
amending Minnesota Statutes 2014, section 160.18, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 160.18, subdivision 3, is amended to read:


Subd. 3.

Access for particular uses.

new text begin (a) new text end The owner or occupant of property
abutting upon a public highway, having a right of direct private access thereto, may
provide such other or additional means of ingress from and egress to the highway as
will facilitate the efficient use of the property for a particular lawful purpose, subject to
reasonable regulation by and permit from the road authority as is necessary to prevent
interference with the construction, maintenance and safe use of the highway and its
appurtenances and the public use thereof.

new text begin (b) In connection with the use of property, and in those cases where an owner of
property abutting a public highway applies for a work permit for temporary placement
of a pressurized flexible force main to be placed in the right-of-way in order to transport
manure for field application, so long as such application identifies the entire length of the
right-of-way used for the force main and so long as all of the conditions with respect to
installation or construction of the force main are complied with over the entire length of the
right-of-way so used, then the applicant may, by a single application, install the force main
over the length of the right-of-way from the owner's property to the property where field
application of manure will be done irrespective of whether the applicant is the owner of all
property abutting the portion of the right-of-way where the force main is to be installed.
