A bill for an act
relating to health; authorizing licensed dentists to administer influenza
vaccinations; providing for liability insurance coverage and insurance
reimbursement; proposing coding for new law in Minnesota Statutes, chapter
150A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [150A.055] ADMINISTRATION OF INFLUENZA IMMUNIZATIONS.

new text begin Practice of dentistry. new text end

new text begin A person licensed to practice dentistry under
sections 150A.01 to 150A.12 shall be deemed to be practicing dentistry while participating
in the administration of an influenza vaccination.

new text begin Qualified dentists. new text end

new text begin The influenza immunization shall be administered
only to patients by licensed dentists who:

new text begin (1) have immediate access to emergency response equipment, including but not
limited to oxygen administration equipment, epinephrine, and other allergic reaction
response equipment; and

new text begin (2) have received training regarding both the administration of the influenza
vaccination and the emergency response to influenza vaccination reactions.

new text begin Insurance coverage and reimbursement of immunizations. new text end

new text begin (a) All
health insurance companies and providers who provide or include influenza immunization
coverage or benefits in Minnesota as part of their health care contract with their subscriber
participants shall extend to those participants the same limits of coverage for payment
of administration of an influenza vaccination that may be provided or administered by a
licensed dentist pursuant to this section.

new text begin (b) All insurers of dental liability or malpractice insurance coverage that is provided
to licensed dentists in Minnesota shall include liability or malpractice insurance coverage
for the administration of influenza immunizations performed by covered subscribers,
subject to all dollar limits of liability coverage contained within the individual policies.

new text begin This section is effective August 1, 2014, and applies to
influenza immunizations performed on or after that date.
