A bill for an act
 relating to commerce; requiring ownership and control of the University of
Minnesota Hospitals by the University of Minnesota or a Minnesota nonprofit;
amending Minnesota Statutes 2012, section 158.02.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 158.02, is amended to read:


158.02 WHAT PATIENTS MAY BE TREATED; RESEARCH WORK.

The University of Minnesota Hospitals shall be primarily and principally designed
for the care of legal residents of Minnesota who are afflicted with a malady, deformity,
or ailment of a nature which can probably be remedied by hospital service and treatment
and who are unable, financially, to secure such care; or, in case of a minor, whose parent,
guardian, trustee, or other person having lawful custody of the minor's person, as the case
may be, is unable financially to secure such care. The University of Minnesota Hospitals
are hereby designated as places of treatment for such persons.

The hospitals shall be utilized for such instruction and for such scientific research
as will promote the welfare of the patients committed to their care and assist in the
application of science to the alleviation of human suffering.

new text begin Ownership and control of the University of Minnesota Hospitals, if not exercised
by the Regents of the University of Minnesota, may only be exercised by a nonprofit
corporation organized under the laws of Minnesota. A Minnesota nonprofit corporation
exercising such ownership shall not agree to transfer ownership or control over any
portion of the University of Minnesota Hospitals to a foreign corporation, cooperative,
partnership, or entity. "Transfer" includes any change in asset ownership resulting from
the nonprofit corporation's merger with or acquisition by a foreign business entity.
