A bill for an act
relating to human services; classifying certain physician assistants as mental
health professionals for purposes of medical assistance; amending Minnesota
Statutes 2010, section 256B.0625, subdivision 42.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 256B.0625, subdivision 42, is amended to
read:


Subd. 42.

Mental health professional.

new text begin (a) new text end Notwithstanding Minnesota Rules,
part 9505.0175, subpart 28, the definition of a mental health professional shall include a
person who is qualified as specified in section 245.462, subdivision 18, clauses (5) and
(6); or 245.4871, subdivision 27, clauses (5) and (6), for the purpose of this section and
Minnesota Rules, parts 9505.0170 to 9505.0475.

new text begin (b) Notwithstanding Minnesota Rules, part 9505.0175, subpart 28, the definition
of a mental health professional shall include a physician assistant working under the
supervision of a physician licensed under chapter 147 and certified by the American
Board of Psychiatry and Neurology or eligible for board certification in psychiatry, for the
purpose of this section and Minnesota Rules, parts 9505.0170 to 9505.0475.
