A bill for an act
relating to education finance; modifying the aid payment schedule for certain
charter schools; amending Minnesota Statutes 2008, section 127A.45, by adding
a subdivision; Minnesota Statutes 2009 Supplement, section 123B.54.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2009 Supplement, section 123B.54, is amended to read:


123B.54 DEBT SERVICE APPROPRIATION.

fiscal year 2011, $9,574,000

in fiscal year 2013 and later are appropriated from the general fund to the commissioner of
education for payment of debt service equalization aid under section 123B.53.

(b) The appropriations in paragraph (a) must be reduced by the amount of any
money specifically appropriated for the same purpose in any year from any state fund.

Sec. 2.

Minnesota Statutes 2008, section 127A.45, is amended by adding a subdivision
to read:

new text begin The board of directors of any charter school
serving fewer than 150 students where the percent of students eligible for special
education services equals 100 percent of the charter school's total enrollment may request
that the commissioner of education accelerate the school's cash flow under this section.
The commissioner must approve a properly submitted request within 30 days of its receipt.
The commissioner must accelerate the school's cash flow aid payments for all state aid
according to the schedule in the school's request and modify the payments to the school
under subdivision 3 accordingly. The commissioner must delay the special education aid
payments to all other school districts and charter schools in proportion to each district
or charter school's total share of regular special education aid such that the overall aid
payment savings from the aid payment shift remains unchanged for any fiscal year.
