A bill for an act
relating to clean water; authorizing use of the clean water legacy account to
support local inflow and infiltration reduction programs; appropriating money
from constitutionally dedicated funds; amending Minnesota Statutes 2009
Supplement, section 114D.45, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2009 Supplement, section 114D.45, subdivision 3,
is amended to read:


Subd. 3.

Purposes.

Subject to appropriation by the legislature, the clean water
legacy account may be spent for the following purposes:

(1) to provide grants, loans, and technical assistance to public agencies and others
who are participating in the process of identifying impaired waters, developing TMDL's,
implementing restoration plans for impaired waters, and monitoring the effectiveness
of restoration;

(2) to support measures to prevent waters from becoming impaired and to improve
the quality of waters that are listed as impaired but do not have an approved TMDL
addressing the impairment;

(3) to provide grants and loans for wastewater and storm water treatment projects
through the Public Facilities Authority;

(4) to support the efforts of public agencies associated with subsurface sewage
treatment systems and financial assistance for upgrading and replacing the systems; deleted text begin anddeleted text end

(5) to provide funds to state agencies to carry out their responsibilities under this

in the metropolitan area, as defined in section 473.121, subdivision 2, through the
Metropolitan Council.

Sec. 2. new text begin APPROPRIATION; INFLOW AND INFILTRATION REDUCTION
PROGRAMS.

new text begin $2,000,000 is appropriated in fiscal year 2011 from the clean water legacy account
to the Metropolitan Council to provide grants or loans for local inflow and infiltration
reduction programs in the metropolitan area, as defined in Minnesota Statutes, section
473.121, subdivision 2, through the Metropolitan Council. This appropriation is available
until expended.
