1.10We, the undersigned conferees for S.F. No. 840 report that we have agreed upon the
1.11items in dispute and recommend as follows:
1.12That the House recede from its amendment and that S.F. No. 840 be further amended
1.13as follows:
1.14Delete everything after the enacting clause and insert:

1.15    "Section 1. Minnesota Statutes 2012, section 181.9413, is amended to read:
1.16181.9413 SICK OR INJURED CHILD CARE LEAVE BENEFITS; CARE
1.17OF RELATIVES.
1.18(a) An employee may use personal sick leave benefits provided by the employer
1.19for absences due to an illness of or injury to the employee's child, as defined in section
1.20181.940, subdivision 4, adult child, spouse, sibling, parent, grandparent, or stepparent,
1.21 for such reasonable periods of time as the employee's attendance with the child may be
1.22necessary, on the same terms upon which the employee is able to use sick leave benefits
1.23for the employee's own illness or injury. This section applies only to personal sick leave
1.24benefits payable to the employee from the employer's general assets.
1.25(b) An employer may limit the use of personal sick leave benefits provided by the
1.26employer for absences due to an illness of or injury to the employee's adult child, spouse,
1.27sibling, parent, grandparent, or stepparent to no less than 160 hours in any 12-month
1.28period. This paragraph does not apply to absences due to the illness or injury of a child, as
1.29defined in section 181.940, subdivision 4.
2.1(c) For purposes of this section, "personal sick leave benefits" means time accrued
2.2and available to an employee to be used as a result of absence from work due to personal
2.3illness or injury, but does not include short-term or long-term disability or other salary
2.4continuation benefits.
2.5(d) For the purpose of this section, "child" includes a stepchild and a biological,
2.6adopted, and foster child.
2.7(e) This section does not prevent an employer from providing greater sick leave
2.8benefits than are provided for under this section.
2.9EFFECTIVE DATE.This section is effective August 1, 2013, and applies to sick
2.10leave used on or after that date.

2.11    Sec. 2. REPORT.
2.12By August 1, 2014, the commissioner of management and budget shall analyze
2.13and report to the standing committees of the house of representatives and senate with
2.14jurisdiction over labor and workplace issues on the impact on the usage of sick leave by
2.15employees of the executive branch of the state as a result of the amendments in section 1."
2.16Delete the title and insert:
2.17"A bill for an act
2.18relating to employment; modifying use of personal sick leave benefits; requiring
2.19a report;amending Minnesota Statutes 2012, section 181.9413."
