  1.1                          A bill for an act 
  1.2             relating to administrative procedure; changing certain 
  1.3             requirements for notifying the legislature of proposed 
  1.4             rulemaking; providing that certain rules remain in 
  1.5             effect; amending Minnesota Statutes 1998, section 
  1.6             14.116. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 14.116, is 
  1.9   amended to read: 
  1.10     14.116 [NOTICE TO LEGISLATURE.] 
  1.11     When an agency mails notice of intent to adopt rules under 
  1.12  section 14.14 or 14.22, the agency must make reasonable efforts 
  1.13  to send a copy of the same notice and a copy of the statement of 
  1.14  need and reasonableness to the following: 
  1.15     (1) all people who are still legislators and who were main 
  1.16  authors, or supporting authors, of the law granting the agency 
  1.17  the statutory authority the agency relies upon as authority to 
  1.18  adopt the proposed rule; and 
  1.19     (2) the chairs of the legislative policy and budget 
  1.20  committees with jurisdiction over the subject matter of the 
  1.21  proposed rules.  In addition, if the mailing of the notice is 
  1.22  within seven years of the effective date of the law the agency 
  1.23  relies on as statutory authority to adopt the proposed rules, 
  1.24  the agency must make a reasonable effort to send copies of the 
  1.25  notice and the statement to all persons who are still 
  1.26  legislators and who were chief authors of that law or any 
  2.1   companion bills to the bill that was enacted. 
  2.2      Sec. 2.  [RULES REMAIN IN EFFECT.] 
  2.3      Notwithstanding Minnesota Statutes, section 14.05, 
  2.4   subdivision 1; 645.36; or other law to the contrary, the rules 
  2.5   adopted under the authority of Minnesota Statutes 1996, section 
  2.6   299A.01, subdivision 6, paragraph (a), remain in effect on and 
  2.7   after July 1, 1997, until further amended or repealed. 
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Sections 1 and 2 are effective the day following final 
  2.10  enactment.  Section 2 applies retroactively to July 1, 1997.
