A bill for an act
relating to state government; establishing a heating and cooling policy for state
building projects funded with state appropriations; proposing coding for new law
in Minnesota Statutes, chapter 16B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A project to construct or significantly renovate a building that receives any state
funding for replacement of heating or cooling systems must review and study geothermal
applications as possible uses for heating or cooling.

When practicable, and notwithstanding any law to the contrary, geothermal heating
and cooling systems must be given preference when designing, planning, or letting bids
for necessary replacement or initial installation of cooling or heating systems in new or
existing state-owned buildings.

The commissioner of administration, in consultation with the commissioner of
commerce, must certify that a project is in compliance with this section before state funds
are provided for the project. The commissioner must receive a written plan for compliance
from a project proposer.

The commissioner shall consider requesting bonding authority to finance geothermal
cooling and heating systems.

Section 1 is effective July 1, 2007, and applies to cooling or heating systems
replacement or installation in state-owned buildings on or after that date.
