  1.1                          A bill for an act 
  1.2             relating to education; modifying tuition provisions 
  1.3             for the Minnesota state academies; amending Minnesota 
  1.4             Statutes 2000, section 125A.65, subdivisions 1, 3, 8, 
  1.5             9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 125A.65, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [RESPONSIBILITY ALLOCATED.] Responsibility 
  1.10  for special instruction and services for a visually 
  1.11  disabled blind/visually impaired or hearing impaired deaf/hard 
  1.12  of hearing child attending the Minnesota state academy for the 
  1.13  deaf or the Minnesota state academy for the blind must be 
  1.14  determined in subdivisions 2 to 10. 
  1.15     Sec. 2.  Minnesota Statutes 2000, section 125A.65, 
  1.16  subdivision 3, is amended to read: 
  1.17     Subd. 3.  [EDUCATIONAL PROGRAM; TUITION.] When it is 
  1.18  determined pursuant to section 125A.69, subdivision 1 or 2, that 
  1.19  the child is entitled to attend either school, the board of the 
  1.20  Minnesota state academies must provide the appropriate 
  1.21  educational program for the child.  The board of the Minnesota 
  1.22  state academies must make a tuition charge to the child's 
  1.23  district of residence for the cost of providing the program.  
  1.24  The amount of tuition charged must not exceed the basic revenue 
  1.25  of the district general education revenue formula allowance 
  2.1   times the pupil unit weighting factor pursuant to section 
  2.2   126C.05 for that child, for the amount of time the child is in 
  2.3   the program.  For purposes of this subdivision, "basic revenue" 
  2.4   has the meaning given it in section 126C.10, subdivision 2.  The 
  2.5   district of the child's residence must pay the tuition and may 
  2.6   claim general education aid for the child.  Tuition received by 
  2.7   the board of the Minnesota state academies, except for tuition 
  2.8   received under subdivision 4, must be deposited in the state 
  2.9   treasury as provided in subdivision 8. 
  2.10     Sec. 3.  Minnesota Statutes 2000, section 125A.65, 
  2.11  subdivision 8, is amended to read: 
  2.12     Subd. 8.  [STUDENT COUNT; TUITION.] On May 1 of each 
  2.13  year, 1996, and each year thereafter, the board of the Minnesota 
  2.14  state academies shall count the actual number of Minnesota 
  2.15  resident kindergarten and elementary students and the actual 
  2.16  number of Minnesota resident secondary special education 
  2.17  eligible students enrolled and receiving education services at 
  2.18  the Minnesota state academy for the deaf and the Minnesota state 
  2.19  academy for the blind.  The board of the Minnesota state 
  2.20  academies shall deposit in the state treasury an amount equal to 
  2.21  all tuition received less:  
  2.22     (1) the total number of students on May 1 less 175, times 
  2.23  the ratio of the number of kindergarten and elementary students 
  2.24  to the total number of students on May 1, times the general 
  2.25  education formula allowance; plus 
  2.26     (2) the total number of students on May 1 less 175, times 
  2.27  the ratio of the number of secondary students on May 1 to the 
  2.28  total number of students on May 1, times 1.3, times the general 
  2.29  education formula allowance.  The Minnesota state academies 
  2.30  shall credit to their general operation account an amount equal 
  2.31  to the tuition received which represents tuition earned for the 
  2.32  total number of students over 175 based on: 
  2.33     (1) the total number of enrolled students on May 1 less 
  2.34  175; times 
  2.35     (2) the ratio of the number of students in that grade 
  2.36  category to the total number of students on May 1; times 
  3.1      (3) the general education revenue formula allowance; times 
  3.2      (4) the pupil unit weighting factor pursuant to section 
  3.3   126C.05. 
  3.4      Sec. 4.  Minnesota Statutes 2000, section 125A.65, 
  3.5   subdivision 9, is amended to read: 
  3.6      Subd. 9.  [CALCULATION.] The sum provided by the 
  3.7   calculation in subdivision 8, clauses (1) and (2), must be 
  3.8   deposited in the state treasury and credited to the general 
  3.9   operation account of the academy for the deaf and the academy 
  3.10  for the blind Minnesota state academy for the deaf and the 
  3.11  Minnesota state academy for the blind.
