relating to crime; establishing offenses involving the sale and purchase of event
tickets; proposing coding for new law in Minnesota Statutes, chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin No operator of any place of entertainment or
agent, representative, employee, or licensee of the operator shall, if a price is charged for
admission, exact, demand, accept, or receive, directly or indirectly, any premium or price
in excess of the established price plus lawful taxes whether designated as price, gratuity,
or otherwise.

new text begin A person who violates subdivision 1 is guilty of a misdemeanor.

charge by the operator or the agents of the operator for special services including, but not
limited to, sales away from the box office, credit card sales, or delivery.

new text begin (a) Whoever intentionally uses an automated device
to purchase, within a 24-hour period, more than eight tickets to an event held in the state is
guilty of a misdemeanor.

new text begin (b) Whoever intentionally uses an automated device to impede, block, or move
ahead of another person seeking to purchase tickets to an event held in the state is guilty
of a gross misdemeanor.

new text begin (a) For purposes of this section, the terms defined in this
subdivision have the meanings given them.

new text begin (b) "Event" means a theater performance or show, circus, athletic contest, or other
entertainment or amusement to which the general public is admitted.

new text begin (c) "Automated device" means a device that after initial human initialization or setup
generates automated requests for tickets without further human interface. The definition
includes, but is not limited to, computer software applications.
