A bill for an act
relating to the environment; requiring a report by the Pollution Control Agency
on new public wastewater treatment facilities that do not meet water quality
discharge standards; requiring bids for new wastewater treatment facilities to
include information on operating costs during the first five years of operation;
amending Minnesota Statutes 2004, section 115.447; proposing coding for new
law in Minnesota Statutes, chapter 115.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 115.447, is amended to read:


115.447 TRACKING REPORT FOR NEW WASTEWATER FACILITIES.

The Pollution Control Agency shall
annually prepare a report tracking the location and capacity of each new wastewater
treatment system requiring a National Pollutant Discharge Elimination System or State
Disposal System permit built after May 1, 2000. The annual report must also provide the
total number of new systems built after that date. The commissioner shall submit the
report to deleted text begin the chairs ofdeleted text end the legislative committees with jurisdiction over environmental
policy and financenew text begin , and publish the report on the agency's Web site,new text end by February 1 of
each year.new text begin The agency shall also send a copy of the report to all known businesses that
provide performance bonds to engineering and contracting firms that provide services for
municipal wastewater treatment facilities in Minnesota.

report required under subdivision 1 shall include information on new public wastewater
treatment facilities requiring a national pollutant discharge elimination system or state
disposal system permit that do not meet water quality discharge standards during the first
five years of operation. For each facility that does not meet the discharge standards, the
agency shall provide information on the location of the facility, the owner of the facility, the
engineering firm that designed the facility, and the contractor who constructed the facility.

REQUIREMENTS.

new text begin A bid for an engineering contract to construct a public wastewater treatment facility
requiring a national pollutant discharge elimination system or state disposal system permit
shall include a detailed estimate of all operation and maintenance costs of operating the
facility for the first five years of operation.
