  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the sale of 
  1.3             certain tax-forfeited lands bordering public waters in 
  1.4             Dakota county to the city of Eagan. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PRIVATE SALE OF TAX-FORFEITED LAND; DAKOTA 
  1.7   COUNTY.] 
  1.8      (a) Notwithstanding Minnesota Statutes, sections 92.45, 
  1.9   103F.535, and 282.018, subdivision 1, paragraph (a), and the 
  1.10  public sale provisions of Minnesota Statutes, chapter 282, 
  1.11  Dakota county may convey to the city of Eagan, without 
  1.12  consideration, the lands bordering public waters that are 
  1.13  described in paragraph (c), under the remaining provisions of 
  1.14  Minnesota Statutes, chapter 282. 
  1.15     (b) The conveyance must be in a form approved by the 
  1.16  attorney general.  The conveyance must provide that, except as 
  1.17  provided in section 2, the land reverts to the state if it is 
  1.18  not used for public park or open space purposes. 
  1.19     (c) The lands that may be conveyed are located in Dakota 
  1.20  county, are designated by the Dakota county parcel number 
  1.21  contained within the parentheses, and are described as: 
  1.22     (1) (Parcel No. 10-01100-011-75) as: 
  1.23     That part of the East Half of the East Half of the 
  1.24  Southeast Quarter of Section 11, Township 27 North, Range 23 
  1.25  West, described as follows: 
  2.1      Commencing at the southeast corner of said Section 11; 
  2.2   thence North 0 degrees 04 minutes 54 seconds East assumed 
  2.3   bearing, along the east line of the Southeast Quarter of said 
  2.4   Section 11, 878.96 feet to the northeast corner of OUTLOT I, 
  2.5   GOPHER INDUSTRIAL PARK 2ND ADDITION, record plat and the point 
  2.6   of beginning of the tract to be described; thence North 89 
  2.7   degrees 37 minutes 34 seconds West along the north line of said 
  2.8   OUTLOT I 660.45 feet to the easterly line of EAGANDALE CENTER 
  2.9   INDUSTRIAL PARK NO. 4, record plat; thence North 0 degrees 07 
  2.10  minutes 28 seconds East along the easterly line of said 
  2.11  EAGANDALE CENTER INDUSTRIAL PARK NO. 4 1406.80 feet to the 
  2.12  southerly line of BORCHERT-INGERSOLL, INC. 1ST ADDITION, record 
  2.13  plat; thence North 76 degrees 29 minutes 44 seconds East along 
  2.14  the southerly line of said BORCHERT-INGERSOLL, INC. 1ST ADDITION 
  2.15  678.38 feet to the east line of the Southeast Quarter of said 
  2.16  Section 11; thence South 0 degrees 04 minutes 54 seconds West 
  2.17  along the east line of said Southeast Quarter 1569.53 feet to 
  2.18  the point of beginning. 
  2.19     Containing 22.54 acres, more or less, subject to a city 
  2.20  drainage and utility easement. 
  2.21     (2) (Parcel No. 10-01200-011-50) as: 
  2.22     That part of the West Half of the Southwest Quarter of 
  2.23  Section 12, Township 27 North, Range 23 West, described as 
  2.24  follows: 
  2.25     Commencing at the southwest corner or said Section 12; 
  2.26  thence North 0 degrees 04 minutes 54 seconds East assumed 
  2.27  bearing, along the west line of the Southwest Quarter of said 
  2.28  Section 12, 878.47 feet to the northwest corner of OUTLOT H, 
  2.29  GOPHER EAGAN INDUSTRIAL PARK 2ND ADDITION, record plat and the 
  2.30  point of beginning of the tract to be described; thence North 89 
  2.31  degrees 55 minutes 06 seconds East along the north line of 
  2.32  OUTLOT H and OUTLOT G, of said GOPHER EAGAN INDUSTRIAL PARK 2ND 
  2.33  ADDITION 1321.39 feet to the east line of the West Half of the 
  2.34  Southwest Quarter of said Section 12; thence North 0 degrees 02 
  2.35  minutes 16 seconds West along the east line of the West half of 
  2.36  said Southwest Quarter 1128.04 feet to the westerly right of way 
  3.1   line of the Soo Line Railroad (formerly the Chicago Milwaukee, 
  3.2   St. Paul and Pacific Railroad); thence North 37 degrees 55 
  3.3   minutes 59 seconds West along said westerly railroad right of 
  3.4   way 804.77 feet to the north line of the West Half of the 
  3.5   Southwest Quarter of said Section 12; thence South 89 degrees 56 
  3.6   minutes 35 seconds West along the north line of said West Half 
  3.7   of the Southwest Quarter 13.20 feet to the southerly line of 
  3.8   BORCHERT-INGERSOLL, INC. 1ST ADDITION, record plat; thence South 
  3.9   76 degrees 29 minutes 44 seconds West along the southerly line 
  3.10  of said BORCHERT-INGERSOLL, INC. 1ST ADDITION 833.52 feet to the 
  3.11  west line of the Southwest Quarter of said Section 12; thence 
  3.12  South 0 degrees 04 minutes 54 seconds West along the west line 
  3.13  of said Southwest Quarter 1570.02 feet to the point of beginning.
  3.14     Containing 48.02 acres, more or less, subject to a city 
  3.15  drainage and utility easement. 
  3.16     Sec. 2.  [CITY OF EAGAN; AUTHORITY TO EXCHANGE LAND.] 
  3.17     The city of Eagan may exchange a portion of the parcel of 
  3.18  land described in section 1, paragraph (c), that does not border 
  3.19  public waters with any owner of property within a one-quarter 
  3.20  mile radius of the land described in section 1, paragraph (c), 
  3.21  for a parcel of land contiguous to the land described in section 
  3.22  1, paragraph (c), and bordering public water.  The conveyance of 
  3.23  any land acquired by the city of Eagan through the exchange must 
  3.24  provide that the land reverts to the state if it is not used for 
  3.25  public park or open space purposes. 
  3.26     Sec. 3.  [EFFECTIVE DATE.] 
  3.27     Sections 1 to 3 are effective the day following final 
  3.28  enactment.
