1.1 A bill for an act 1.2 relating to local government; providing for the 1.3 distribution of certain federal payments; amending 1.4 Minnesota Statutes 1996, section 471.653. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1996, section 471.653, is 1.7 amended to read: 1.8 471.653 [DISTRIBUTION OF CERTAIN FEDERAL PAYMENTS.] 1.9 Federal payment in lieu of taxes on entitlement lands made 1.10 pursuant to United States Code, title 31, sections 6901 to 6906 1.11 must be transferred by a county to the home rule or statutory 1.12 city or town where the entitlement land is locatedif the county1.13board determines that the statutory or home rule city or town is1.14the principal provider of governmental services affecting the1.15use of entitlement lands and if the total annual federal payment1.16to the county is $5,000 or more. The county board shall make1.17its determination based on factors which must include: (1)1.18whether the city or town has at least 60 acres of land within1.19the entitlement lands; (2) whether city or town roads are the1.20primary access to the entitlement lands; (3) whether the city or1.21town provides specific services to the entitlement lands such as1.22fire protection, police protection, and search and rescue1.23services; and (4) whether the city or town is primarily1.24responsible for land use planning and official controlsin the 1.25 same proportion that other parcels in the county pay to the 2.1 respective statutory or home rule charter city or town. 2.2 The distribution of federal payment in lieu funds shall be 2.3 made by the county board to a qualifying city or town in the 2.4 proportion that the acreage of entitlement land located in each 2.5 bears to the total acreage of entitlement land in the county. 2.6 If more than 25 percent of entitlement acreage in a county is 2.7 located in qualifying cities or towns, there shall be a pro rata 2.8 reduction in each qualifying city or town's share, so that only 2.9 30 percent of the total county payment is distributed. 2.10 Sec. 2. [EFFECTIVE DATE.] 2.11 Section 1 is effective the day following its final 2.12 enactment.
