  1.1                          A bill for an act 
  1.2             relating to education; requiring students under the 
  1.3             age of seven to complete kindergarten prior to being 
  1.4             admitted to first grade in the 2005-2006 school year 
  1.5             and thereafter; authorizing waivers; amending 
  1.6             Minnesota Statutes 2002, section 120A.22, subdivision 
  1.7             5. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 120A.22, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [AGES AND TERMS.] (a) Every child between seven 
  1.12  and 16 years of age must receive instruction.  Every child under 
  1.13  the age of seven who is enrolled in a half-day kindergarten, or 
  1.14  a full-day kindergarten program on alternate days, or other 
  1.15  kindergarten programs shall receive instruction.  Except as 
  1.16  provided in subdivision 6, a parent may withdraw a child under 
  1.17  the age of seven from enrollment at any time. 
  1.18     (b) Any child under the age of seven who is enrolled in 
  1.19  school must complete a kindergarten program prior to being 
  1.20  admitted to first grade unless this requirement is waived for an 
  1.21  individual student by the board or the designated member of the 
  1.22  administration of the school or school district for good cause 
  1.23  shown. 
  1.24     (c) A school district by annual board action may require 
  1.25  children subject to this subdivision to receive instruction in 
  1.26  summer school.  A district that acts to require children to 
  2.1   receive instruction in summer school shall establish at the time 
  2.2   of its action the criteria for determining which children must 
  2.3   receive instruction. 
  2.4      [EFFECTIVE DATE.] This section is effective July 1, 2005, 
  2.5   and applies to enrollment in a school or school district in the 
  2.6   2005-2006 school year and thereafter.
