  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11                             ARTICLE 1 
  1.12                           TRANSPORTATION 
  1.13  Section 1.  [TRANSPORTATION APPROPRIATIONS AND TRANSFERS.] 
  1.14     The dollar amounts in the columns under "APPROPRIATION 
  1.15  CHANGE" are added to or, if shown in parentheses, are subtracted 
  1.16  from the appropriations in Laws 2001, First Special Session 
  1.17  chapter 8, as amended, or other law to the specified agencies.  
  1.18  The appropriations are from the general fund or other named fund 
  1.19  and are available for the fiscal years indicated for each 
  1.20  purpose.  The figure "2003" means that the addition to or 
  1.21  subtraction from the appropriations listed under the figure is 
  1.22  for the fiscal year ending June 30, 2003.

  1.28                        APPROPRIATION CHANGE 
  2.1   Sec. 2.  TRANSPORTATION                             110,000,000 
  2.2   This appropriation is from the trunk 
  2.3   highway bond proceeds account in the 
  2.4   trunk highway fund and is available for 
  2.5   expenditure beginning the day following 
  2.6   final enactment.  It is for the same 
  2.7   purposes as specified in Laws 2000, 
  2.8   chapter 479, article 1, section 2, 
  2.9   subdivision 3. 
  2.10  Of the general fund appropriation in 
  2.11  Laws 2000, chapter 479, article 1, 
  2.12  section 2, subdivision 3, $110,000,000 
  2.13  cancels to the general fund.  This 
  2.14  cancellation is effective the day 
  2.15  following final enactment. 
  2.16  By June 30, 2003, the commissioner of 
  2.17  finance shall transfer $15,000,000 of 
  2.18  the cash balance in the state airports 
  2.19  fund established in Minnesota Statutes, 
  2.20  section 360.017, to the general fund. 
  2.21  Sec. 3.  BOND SALE EXPENSES                             110,000 
  2.22  To the commissioner of finance for bond 
  2.23  sale expenses under Minnesota Statutes, 
  2.24  section 16A.641, subdivision 8.  This 
  2.25  appropriation is from the trunk highway 
  2.26  bond proceeds account in the trunk 
  2.27  highway fund. 
  2.28  Sec. 4.  BOND SALE AUTHORIZATION                     
  2.29  To provide the money appropriated in 
  2.30  this act from the trunk highway bond 
  2.31  proceeds account in the trunk highway 
  2.32  fund, the commissioner of finance shall 
  2.33  sell and issue bonds of the state in an 
  2.34  amount up to $110,110,000 in the 
  2.35  manner, upon the terms, and with the 
  2.36  effect prescribed by Minnesota 
  2.37  Statutes, sections 167.50 to 167.52, 
  2.38  and by the Minnesota Constitution, 
  2.39  article XIV, section 11, at the times 
  2.40  and in the amount requested by the 
  2.41  commissioner of transportation.  The 
  2.42  proceeds of the bonds, except accrued 
  2.43  interest and any premium received on 
  2.44  the sale of the bonds, must be credited 
  2.45  to the trunk highway bond proceeds 
  2.46  account in the trunk highway fund. 
  2.47     Sec. 5.  [EFFECTIVE DATE.] 
  2.48     Sections 1 to 4 are effective the day following final 
  2.49  enactment. 
  2.50                             ARTICLE 2 
  2.51                             TRANSFERS 
  2.52     Section 1.  [SELF LOAN RESERVE FUND TRANSFER.] 
  2.53     Notwithstanding any law to the contrary, by June 30, 2003, 
  2.54  the higher education services office shall transfer $30,000,000 
  2.55  of uncommitted balances in the SELF loan reserve fund to the 
  3.1   general fund.  This is a onetime transfer.  
  3.2      Sec. 2.  [STATE-OPERATED SERVICES TRANSFER.] 
  3.3      The commissioner of human services shall transfer 
  3.4   $3,200,000 from the TBI enterprise, $1,000,000 from lease 
  3.5   income, and $500,000 from the ICF/MR depreciation accounts to 
  3.6   the general fund, effective the day following final enactment. 
  3.7      Sec. 3.  [SOLID WASTE FUND TRANSFER.] 
  3.8      By June 30, 2003, the commissioner of the pollution control 
  3.9   agency shall transfer $11,000,000 from the unreserved balance of 
  3.10  the solid waste fund to the commissioner of finance for 
  3.11  cancellation to the general fund. 
  3.12     Sec. 4.  Laws 2002, chapter 220, article 13, section 9, 
  3.13  subdivision 2, as amended by Laws 2002, chapter 374, article 8, 
  3.14  section 6, is amended to read: 
  3.15     Subd. 2.  [SPECIAL COMPENSATION FUND.] After June 1, 2003, 
  3.16  but no later than June 30, 2003, the commissioner of finance 
  3.17  shall transfer $250,000,000 $265,000,000 in assets of the excess 
  3.18  surplus account of the special compensation fund created under 
  3.19  Minnesota Statutes, section 176.129, to the general fund. 
  3.20     Sec. 5.  [EFFECTIVE DATE.] 
  3.21     Sections 1 to 4 are effective the day following final 
  3.22  enactment.

  7.15                           MISCELLANEOUS
  7.16     Section 1.  Minnesota Statutes 2002, section 127A.45, 
  7.17  subdivision 7a, is amended to read: 
  7.18     Subd. 7a.  [ADVANCE FINAL PAYMENT.] (a) Notwithstanding 
  7.19  subdivisions 3 and 7, a school district or a charter school 
  7.20  exceeding its expenditure limitations under section 123B.83 as 
  7.21  of June 30 of the prior fiscal year may receive a portion of its 
  7.22  final payment for the current fiscal year on June 20, if 
  7.23  requested by the district.  The amount paid under this 
  7.24  subdivision must not exceed the lesser of: 
  7.25     (1) seven percent of the district or charter school's 
  7.26  general education aid for the current fiscal year; or 
  7.27     (2) the amount by which the district or charter school's 
  7.28  net negative unreserved general fund balance as of June 30 of 
  7.29  the prior fiscal year exceeds 2.5 percent of the district or 
  7.30  charter school's expenditures for that fiscal year. 
  7.31     (b) The state total advance final payment under this 
  7.32  subdivision for any year must not exceed $17,500,000 $12,000,000.
  7.33  If the amount requested exceeds $17,500,000 $12,000,000, the 
  7.34  advance final payment for each eligible district must be reduced 
  7.35  proportionately. 
  7.36     Sec. 2.  Laws 2001, First Special Session chapter 9, 
  8.1   article 17, section 10, subdivision 1, is amended to read: 
  8.2   Subdivision 1.  Grants
  8.3   The commissioner of human services, 
  8.4   with the approval of the commissioner 
  8.5   of finance, and after notification of 
  8.6   the chair of the senate health, human 
  8.7   services and corrections budget 
  8.8   division and the chair of the house 
  8.9   health and human services finance 
  8.10  committee, may transfer unencumbered 
  8.11  appropriation balances for the biennium 
  8.12  ending June 30, 2003, within fiscal 
  8.13  years among the MFIP, MFIP child care 
  8.14  assistance under Minnesota Statutes, 
  8.15  section 119B.05, general assistance, 
  8.16  general assistance medical care, 
  8.17  medical assistance, Minnesota 
  8.18  supplemental aid, and group residential 
  8.19  housing programs, and the entitlement 
  8.20  portion of the chemical dependency 
  8.21  consolidated treatment fund, and 
  8.22  between fiscal years of the biennium. 
  8.23     Sec. 3.  [BOARD OF CHIROPRACTIC EXAMINERS DEFICIENCY.] 
  8.24     $70,000 is transferred from the state government special 
  8.25  revenue fund under Laws 2001, First Special Session chapter 10, 
  8.26  article 1, section 33, in fiscal year 2003 to the board of 
  8.27  chiropractic examiners to pay for contested case activity.  This 
  8.28  appropriation is available until September 30, 2003. 
  8.29     Sec. 4.  [SECRETARY OF STATE.] 
  8.30     $368,000 is appropriated from the general fund in fiscal 
  8.31  year 2003 to the secretary of state to fund the legal costs 
  8.32  associated with the 2002 redistricting court case.  
  8.33     Sec. 5.  [BOARD ON JUDICIAL STANDARDS.] 
  8.34     $35,000 is appropriated from the general fund in fiscal 
  8.35  year 2003 to the board on judicial standards to fund costs of a 
  8.36  public hearing for a judge.  This appropriation is available 
  8.37  until expended. 
  8.38     Sec. 6.  [EFFECTIVE DATE OF MINNESOTA STATUTES, SECTION 
  8.39  144.395.] 
  8.40     Notwithstanding the effective date in Laws 2002, chapters 
  8.41  220, article 14, section 12, and 374, article 8, section 8, the 
  8.42  amendments to Minnesota Statutes, section 144.395, subdivision 
  8.43  1, in Laws 2002, chapters 220, article 14, section 6, and 374, 
  8.44  article 8, section 3, are effective the day following final 
  8.45  enactment of this section. 
  9.1      Sec. 7.  [CARRYFORWARD.] 
  9.2      Notwithstanding Minnesota Statutes, section 16A.28, or 
  9.3   other law to the contrary, funds encumbered by the judicial or 
  9.4   executive branch for severance costs, unemployment compensation 
  9.5   costs, and health, dental, and life insurance continuation costs 
  9.6   resulting from state employee layoffs during the fiscal year 
  9.7   ending June 30, 2003, may be carried forward and may be spent 
  9.8   until January 1, 2004. 
  9.9      Sec. 8.  [EFFECTIVE DATE.] 
  9.10     This article is effective the day following final enactment.
