A bill for an act
relating to commerce; clarifying the definition of "motor vehicle" in the statutory
provision deeming the driver to be the agent of the owner in case of accident;
amending Minnesota Statutes 2008, section 169.09, subdivision 5a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 169.09, subdivision 5a, is amended to read:


Subd. 5a.

Driver deemed agent of owner.

Whenever any motor vehicle shall be
operated within this state, by any person other than the owner, with the consent of the
owner, express or implied, the operator thereof shall in case of accident, be deemed the
agent of the owner of such motor vehicle in the operation thereof. For purposes of this
subdivision, "motor vehicle" has the meaning given in section 65B.43, subdivision 2.

EFFECTIVE DATE.

This section is effective the day following final enactment.
