1.1 A bill for an act 1.2 relating to the city of St. Paul; making technical 1.3 changes to the civic center authority powers and 1.4 duties; amending Laws 1967, chapter 459, section 8, 1.5 subdivisions 1, 3, 4, as amended. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Laws 1967, chapter 459, section 8, subdivision 1.8 1, as added by Laws 1969, chapter 1138, section 3, is amended to 1.9 read: 1.10 Subdivision 1. There is created an agency of the city of 1.11 Saint Paul known as thecivic centerRiverCentre authority. 1.12 The authority shall have nine members. Seven public 1.13 members shall be appointed by the mayor, with the consent of the 1.14 council, and shall hold no other public office save notary 1.15 public. Two members shall be designated by the mayor from among 1.16 the members of the city council. 1.17 Until termination of the guarantees provided hereunder five 1.18 of the seven public members shall be appointed from among 1.19 nominees presented to the mayor by the guarantors. Three of the 1.20 five public members nominated by the guarantors, and the two not 1.21 so nominated, shall reside in Saint Paul. 1.22 Three of the public members first appointed shall serve 1.23 two-year terms. All other appointments of public members shall 1.24 be for four-year terms, to expire on July 1 of the year of 1.25 expiration.CouncilmenCouncilmembers shall servetwo-year2.1 four-year termsexpiring the first Tuesday in June in each2.2even-numbered yearbeginning on the first business day of 2.3 January of the year after their election. 2.4 All appointments to fill vacancies shall be for the 2.5 remainder of the unexpired term. 2.6 Members of the Authority shall serve without compensation 2.7 but may be reimbursed for their necessary expenses. 2.8 Any public member may be removed by the mayor, with the 2.9 consent of the council, for good cause shown. 2.10 The authority shall elect, for one-year terms, a chairman 2.11 and such other officers as it may deem appropriate. 2.12 Sec. 2. Laws 1967, chapter 459, section 8, subdivision 3, 2.13 as added by Laws 1969, chapter 1138, section 3, is amended to 2.14 read: 2.15 Subd. 3. To discharge its responsibilities the authority 2.16 shall have power to: 2.17 (1) appoint and at its pleasure remove a managing director 2.18 and a deputy director and fix their compensation. 2.19 (2) use the services of the Civil Service Department of the 2.20 city of St. Paul to secure such other employees as may be 2.21 necessary to operate the authority and the civic center, who 2.22 shall be in the classified service of the city of St. Paul. 2.23 (3) manage the civic center, and make regulations regarding 2.24 its use, and in particular prescribe the charges to be made for 2.25 its use, determine when free use shall be granted for worthy 2.26 civic activities, and control the actions of any person licensed 2.27 for the sale of intoxicating liquor upon the premises of the 2.28 center. This enumeration of powers shall not be construed as a 2.29 limitation upon the general powers of the authority. 2.30 (4) make contracts and purchases which shall, except as 2.31 provided in Subdivision 5, be made as in the case of other city 2.32 agencies and bureaus. 2.33 (5) accept and expend according to their terms any gifts 2.34 from governments orindividualspersons for civic center 2.35 purposes. 2.36 Sec. 3. Laws 1967, chapter 459, section 8, subdivision 4, 3.1 as added by Laws 1969, chapter 1138, section 3, is amended to 3.2 read: 3.3 Subd. 4. Receipts of the authority shall be deposited to 3.4 its credit in a revolving fund in the city treasury and expended 3.5 in accordance with an annual budget. The budget shall be 3.6 submitted to the comptroller beforeAugust 15October 31 of each 3.7 year and shall be transmitted by him, without modification, to 3.8 the council as part of his budget estimates. The council may 3.9 modify the budget of the authority only with respect to those 3.10 amounts proposed to be financed by general revenues of the city 3.11 or bond proceeds. 3.12 The budget shall follow the method of subdivision into 3.13 items prescribed for other city agencies and bureaus but may, in 3.14 the discretion of the authority, be on an accrual basis, and all 3.15 sums remaining to the credit of the authority at the close of 3.16 the city's budget year shall be automatically appropriated to 3.17 its credit for the following year. 3.18 The city may levy in 1970, in addition to other levies 3.19 permitted by law or charter, an ad valorem tax sufficient to pay 3.20 all deferred free use charges currently payable to the present 3.21 auditorium fund, which shall be credited to the authority's 3.22 revolving fund. 3.23 Sec. 4. [EFFECTIVE DATE; LOCAL APPROVAL.] 3.24 Section 1 is effective the day after the governing body of 3.25 St. Paul and its chief clerical officer timely complete their 3.26 compliance with Minnesota Statutes, section 645.021, 3.27 subdivisions 2 and 3.
