  1.1                          A bill for an act 
  1.2             relating to local government; providing an exception 
  1.3             to the conflict of interest law for township officers; 
  1.4             authorizing the town of White to be reimbursed by the 
  1.5             city of Biwabik according to their orderly annexation 
  1.6             agreement; amending Minnesota Statutes 2002, section 
  1.7             471.88, by adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 471.88, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 20.  [TOWNSHIP SUPERVISOR IS EMPLOYEE OF CONTRACTOR.] 
  1.12  A township may enter into a contract governed by section 
  1.13  471.345, even if a township supervisor is an employee of the 
  1.14  contractor as long as the supervisor had no role in preparing 
  1.15  the contractor's bid or negotiation for the contract with the 
  1.16  township.  The supervisor is not precluded from continuing to 
  1.17  serve as a township official during the term of the contract if 
  1.18  the township supervisor abstains from voting on any official 
  1.19  action relating to the contract and discloses the supervisor's 
  1.20  reason for the abstention in the official minutes of the 
  1.21  township meeting. 
  1.22     Sec. 2.  [BIWABIK, TOWN OF WHITE; REIMBURSEMENT SCHEDULE.] 
  1.23     Notwithstanding the limitations on duration or equality of 
  1.24  payment under Minnesota Statutes, section 414.036, the city of 
  1.25  Biwabik may reimburse the town of White for orderly annexed 
  1.26  property for a period of time and in amounts agreed to by the 
  2.1   city and town under an orderly annexation agreement, approved by 
  2.2   the city and town after September 1, 2002, pursuant to Minnesota 
  2.3   Statutes, section 414.0325. 
  2.4      Sec. 3.  [LOCAL APPROVAL; EFFECTIVE DATE.] 
  2.5      Section 2 is effective under Minnesota Statutes, section 
  2.6   645.02, the day after the governing bodies of both the town of 
  2.7   White and the city of Biwabik and their respective chief 
  2.8   clerical officers timely complete their compliance with 
  2.9   Minnesota Statutes, section 645.021, subdivisions 2 and 3.
