A bill for an act
relating to natural resources; modifying restrictions on access to created or
restored wetlands; amending Minnesota Statutes 2006, section 103G.235.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 103G.235, is amended to read:


103G.235 RESTRICTIONS ON ACCESS TO deleted text begin PUBLIC WATERSdeleted text end WETLANDS.

new text begin Wetlands adjacent to roads. new text end

To protect the public health or safety,
local units of government may by ordinance restrict public access to public waters
wetlands from municipality, county, or township roads that abut public waters wetlands.

new text begin Privately restored or created wetlands. new text end

new text begin When a landowner creates
or restores a wetland on private land that is adjacent to public land or a public road
right-of-way, there is no public access to the created or restored wetland as posted by the
landowner, except if the landowner grants permission for such access.
