A bill for an act
relating to natural resources; authorizing certain Chippewa Bands to establish open
seasons for big game in accordance with 1854 treaty; modifying prior appropriation;
amending Minnesota Statutes 2022, section 97A.157, subdivision 4; Laws 2023,
chapter 60, article 1, section 3, subdivision 9; proposing coding for new law in
Minnesota Statutes, chapter 97B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2022, section 97A.157, subdivision 4, is amended to read:
The commissioner of natural resources,
on behalf of the state of Minnesota, shall take all actions, by rule or otherwise, necessary
to carry out the duties and obligations of the state of Minnesota arising from the
Memorandum of Agreementnew text begin , as amendednew text end . Powers and duties provided by this subdivision
apply to payment of money under the Memorandum of Agreement only to the extent and
to the amount specifically appropriated by the legislature to carry out the terms of the
Memorandum of Agreement.

If the commissioner does not establish an open season for taking a species of big game,
a Chippewa Band identified in section 97A.157, subdivision 1, may establish an open season,
independently of the state, for members of the band to take the species.

(a) $510,000 the first year and $510,000 the
second year are from the natural resources
fund for grants to be divided equally between
the city of St. Paul for the Como Park Zoo and
Conservatory and the city of Duluth for the
Lake Superior Zoo. This appropriation is from
revenue deposited to the natural resources fund
under Minnesota Statutes, section 297A.94,
paragraph (h), clause (5).
(b) $211,000 the first year and $221,000 the
second year are for the Office of School Trust
Lands.
(c) $250,000 the first year and $150,000 the
second year are transferred from the forest
suspense account to the permanent school fund
and are appropriated from the permanent
school fund for transaction and project
management costs for divesting of school trust
lands within Boundary Waters Canoe Area
Wilderness.
(d) $323,000 the first year and $334,000 the
second year are transferred from the forest
suspense account to the permanent school fund
and are appropriated from the permanent
school fund for the Office of School Trust
Lands.
(e) $3,000,000 the first year and $3,000,000
the second year are for proportional payments
to Tribes receiving payments under Minnesota
Statutes, section 97A.157. deleted text begin This is a onetime
appropriation.deleted text end The commissioner must work
with the signatory Tribes to update and amend
the affected agreement.
