A bill for an act
relating to education finance; modifying certain petition requirements for
proposals for detachment and annexation; amending Minnesota Statutes 2010,
section 123A.45, subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2010, section 123A.45, subdivision 2, is amended to read:
The petition must contain:
(a) A correct description of the area proposed for detachment and annexation,
including supporting data regarding location and title to land to establish that the land is
adjoining a district.
(b) The reasons for the proposed change with facts showing that the granting of the
petition will not reduce the size of any district to less than four sections, unless the district
is not operating a school within the district.
(c) Consent to the petition, if, at the time of the filing of the petition, any part of
the area proposed for detachment is part of a district which maintains and operates a
secondary school within the district. Before the hearing, the consent of the board of the
district in which the area proposed for detachment lies must be endorsed on the petition.new text begin
Consent of the board of the district where the area proposed for detachment lies is not
required if the area proposed for detachment at the time the petition is filed:

(1) lies in the seven-county metropolitan area;

(2) is located in a city;
new text end
new text begin
(3) is not served by a resident school district school building located within that
city; and

(4) is located in a city where the district proposed for annexation operates a school.

(d) An identification of the district to which annexation is sought.
(e) Other information the petitioners may desire to affix.
(f) An acknowledgment by the petitioner.
(g) A description of whether bonded indebtedness will be allocated according to
subdivision 6, paragraph (b) or (c).
