A bill for an act
relating to human services; expanding medical assistance coverage to include
prescription digital therapeutics; amending Minnesota Statutes 2020, section
256B.0625, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 256B.0625, is amended by adding a subdivision
to read:


Subd. 3i.

Prescription digital therapeutics.

Medical assistance covers prescription
digital therapeutics. For purposes of this subdivision, "prescription digital therapeutics"
means a product, device, Internet application, or other technology that:

(1) is approved, cleared, or classified by the Food and Drug Administration under section
510(k), 513(f), or 515 of the Federal Food, Drug, and Cosmetic Act;

(2) has an approved or cleared indication for the prevention, management, or treatment
of a medical disease, condition, or disorder;

(3) uses software primarily to achieve its intended result; and

(4) can only be dispensed pursuant to a prescription.

EFFECTIVE DATE.

This section is effective July 1, 2022, or upon federal approval,
whichever is later. The commissioner of human services must notify the revisor of statutes
when federal approval is obtained.
