1.1A bill for an act
1.2relating to public safety; permitting law enforcement access to Department of
1.3Human Services electronic civil commitment data for a background check on an
1.4applicant for a permit to possess explosives; allowing minors to be employed
1.5in certain retail stores;amending Minnesota Statutes 2010, sections 181A.04,
1.6subdivision 5; 245.041.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2010, section 181A.04, subdivision 5, is amended to
1.9read:
1.10    Subd. 5. Hazardous occupations. No minor under the age of 18 shall be permitted
1.11to work in any occupation which the commissioner shall find to be particularly hazardous
1.12for the employment of children under 18 years of age or detrimental to their well-being. A
1.13list of such occupations shall be established and promulgated by rule pursuant to section
1.14181A.09 . Notwithstanding any law or rule to the contrary, this subdivision does not apply
1.15to minors employed in retail stores that are nonseasonal and are of a nontransient nature
1.16and which sell or offer for sale explosives or pyrotechnics.
1.17EFFECTIVE DATE.This section is effective the day following final enactment.

1.18    Sec. 2. Minnesota Statutes 2010, section 245.041, is amended to read:
1.19245.041 PROVISION OF FIREARMS AND EXPLOSIVES BACKGROUND
1.20CHECK INFORMATION.
1.21Notwithstanding section 253B.23, subdivision 9, the commissioner of human
1.22services shall provide commitment information to local law enforcement agencies on an
1.23individual request basis by means of electronic data transfer from the Department of
2.1Human Services through the Minnesota Crime Information System for the sole purpose of
2.2facilitating a firearms background check under section 624.7131, 624.7132, or 624.714,
2.3or an explosives background check under section 299F.73, 299F.74, 299F.75, 299F.77,
2.4or 299F.785. The information to be provided is limited to whether the person has been
2.5committed under chapter 253B and, if so, the type of commitment.
