  1.1                          A bill for an act 
  1.2             relating to gambling; eliminating the maximum table 
  1.3             requirement and providing for reasonable accommodation 
  1.4             at card clubs; regulating raffles conducted by certain 
  1.5             organizations and individuals; amending Minnesota 
  1.6             Statutes 2002, section 240.30, subdivision 8, by 
  1.7             adding a subdivision; Minnesota Statutes 2003 
  1.8             Supplement, section 349.166, subdivision 1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 240.30, 
  1.11  subdivision 8, is amended to read: 
  1.12     Subd. 8.  [LIMITATIONS.] The commission may not approve any 
  1.13  plan of operation under subdivision 6 that exceeds any of the 
  1.14  following limitations: 
  1.15     (1) the maximum number of tables used for card playing at 
  1.16  the card club at any one time, other than tables used for 
  1.17  instruction, demonstrations, or tournament play, may not exceed 
  1.18  50.  The table limit exception for tournament play is allowed 
  1.19  for only one tournament per year that lasts for no longer than 
  1.20  14 days; 
  1.21     (2) except as provided in clause (3) (2), no wager may 
  1.22  exceed $60; 
  1.23     (3) (2) for games in which each player is allowed to make 
  1.24  only one wager or has a limited opportunity to change that 
  1.25  wager, no wager may exceed $300. 
  1.26     Sec. 2.  Minnesota Statutes 2002, section 240.30, is 
  1.27  amended by adding a subdivision to read: 
  2.1      Subd. 11.  [REASONABLE ACCOMMODATION.] For purposes of this 
  2.2   section and compliance with chapter 363 and the Americans with 
  2.3   Disability Act, a reasonable accommodation includes provision of 
  2.4   a person to read cards to a visually impaired person or the 
  2.5   provision of braille cards. 
  2.6      Sec. 3.  Minnesota Statutes 2003 Supplement, section 
  2.7   349.166, subdivision 1, is amended to read: 
  2.8      Subdivision 1.  [EXCLUSIONS.] (a) Bingo, with the exception 
  2.9   of linked bingo games, may be conducted without a license and 
  2.10  without complying with sections 349.168, subdivisions 1 and 2; 
  2.11  349.17, subdivisions 1, 4, and 5; 349.18, subdivision 1; and 
  2.12  349.19, if it is conducted:  
  2.13     (1) by an organization in connection with a county fair, 
  2.14  the state fair, or a civic celebration and is not conducted for 
  2.15  more than 12 consecutive days and is limited to no more than 
  2.16  four separate applications for activities applied for and 
  2.17  approved in a calendar year; or 
  2.18     (2) by an organization that conducts four or fewer bingo 
  2.19  occasions in a calendar year.  
  2.20     An organization that holds a license to conduct lawful 
  2.21  gambling under this chapter may not conduct bingo under this 
  2.22  subdivision.  
  2.23     (b) Bingo may be conducted within a nursing home or a 
  2.24  senior citizen housing project or by a senior citizen 
  2.25  organization if the prizes for a single bingo game do not exceed 
  2.26  $10, total prizes awarded at a single bingo occasion do not 
  2.27  exceed $200, no more than two bingo occasions are held by the 
  2.28  organization or at the facility each week, only members of the 
  2.29  organization or residents of the nursing home or housing project 
  2.30  are allowed to play in a bingo game, no compensation is paid for 
  2.31  any persons who conduct the bingo, and a manager is appointed to 
  2.32  supervise the bingo.  Bingo conducted under this paragraph is 
  2.33  exempt from sections 349.11 to 349.23, and the board may not 
  2.34  require an organization that conducts bingo under this 
  2.35  paragraph, or the manager who supervises the bingo, to register 
  2.36  or file a report with the board.  The gross receipts from bingo 
  3.1   conducted under the limitations of this subdivision are exempt 
  3.2   from taxation under chapter 297A.  
  3.3      (c) Raffles may be conducted by an organization or an 
  3.4   individual without a license and without complying with sections 
  3.5   349.154 to 349.165 and 349.167 to 349.213 if the value of all 
  3.6   raffle prizes awarded by the organization or individual in a 
  3.7   calendar year does not exceed $1,500, and if the net profits of 
  3.8   the raffles are expended or contributed pursuant to section 
  3.9   349.12, subdivision 25.  The organization or individual must 
  3.10  register with the board on a form provided by the board before 
  3.11  raffles may be conducted under this paragraph. 
  3.12     (d) Except as provided in paragraph (b), the 
  3.13  organization or individual must maintain all required records of 
  3.14  excluded gambling activity for 3-1/2 years.
