A bill for an act
relating to transportation; highways; requiring the commissioner of transportation
to utilize pavement material with a design life of at least 20 years; amending
Minnesota Statutes 2016, section 174.185, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 174.185, is amended by adding a subdivision
to read:


Subd. 4.

Pavement design life.

(a) For purposes of this subdivision, "applicable project"
means a trunk highway project:

(1) that is categorized in the statewide transportation improvement program with a
program category of major construction, reconstruction, reconditioning, or resurfacing;

(2) that adds, removes, or replaces a pavement surface layer by more than two inches
of paving material thickness;

(3) that involves within the construction limits:

(i) on a two-lane road, more than two miles of length of roadway; or

(ii) on a multilane road, more than 30,000 square yards of paving; and

(4) for which a notable portion of the roadway has a remaining service life of 15 years
or less.

(b) For each applicable project, the commissioner must select pavement material that
has a design life of at least 30 years. For purposes of determining pavement design life
under this subdivision, the commissioner may not consider the life of pavement following
planned maintenance or repairs.

EFFECTIVE DATE.

This section is effective July 1, 2017.
