  1.1                          A bill for an act 
  1.2             relating to health; placing the term "assisted living 
  1.3             facility" into statute as a formal means of referring 
  1.4             to registered housing with services establishments; 
  1.5             amending Minnesota Statutes 2002, section 144D.01, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 144D.01, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 8.  [ASSISTED LIVING FACILITY.] "Assisted living 
  1.11  facility" includes but is not limited to a housing with services 
  1.12  establishment that is registered according to section 144D.03, 
  1.13  provided that the operator of the establishment separately 
  1.14  holds, or when applicable has a contractual arrangement with an 
  1.15  individual or entity that holds, a home care license or other 
  1.16  license, permit, registration, or other governmental approval as 
  1.17  is legally required for delivery of the services the 
  1.18  establishment offers or provides to its residents.
