A bill for an act
relating to agriculture; requiring depopulation of farmed Cervidae herd when an
animal is infected with chronic wasting disease; amending Minnesota Statutes
2018, section 35.155, subdivision 11.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2018, section 35.155, subdivision 11, is amended to read:
(a)
An inventory for each farmed Cervidae herd must be verified by an accredited veterinarian
and filed with the Board of Animal Health every 12 months.
(b) Movement of farmed Cervidae from any premises to another location must be reported
to the Board of Animal Health within 14 days of the movement on forms approved by the
Board of Animal Health.
(c) All animals from farmed Cervidae herds that are over 16 months of age that die or
are slaughtered must be tested for chronic wasting disease.

(d) If an animal in a farmed Cervidae herd tests positive for chronic wasting disease,
the entire herd must be euthanized and disposed of at the owner's expense, unless state and
federal funds are available for this purpose. The method by which a herd is euthanized and
disposed of as required by this paragraph must be done in a manner approved by the board.
The board shall consult with the commissioner of natural resources in approving euthanization
and disposal methods.
