1.1 A bill for an act 1.2 relating to crime; imposing penalties for killing or 1.3 injuring a search and rescue dog; amending Minnesota 1.4 Statutes 1998, section 609.596. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1998, section 609.596, is 1.7 amended to read: 1.8 609.596 [KILLING OR HARMING APOLICE, CORRECTIONS OR1.9ARSONPUBLIC SAFETY DOG.] 1.10 Subdivision 1. [FELONY.]WhoeverIt is a felony for any 1.11 person to intentionally and without justificationcausescause 1.12 the death of a police dog, a search and rescue dog, or an arson 1.13 dog when the dog is involved in law enforcement, fire, or 1.14 correctional investigation or apprehension, search and rescue 1.15 duties, or the dog is in the custody of or under the control of 1.16 a peace officer,as defined in section 626.84, subdivision 1,1.17paragraph (c),a trained handler, or an employee of a 1.18 correctional facility, as defined in section 241.021,1.19subdivision 1, clause (5), is guilty of a felony and. A person 1.20 convicted under this subdivision may be sentenced to 1.21 imprisonment for not more than two years or to payment of a fine 1.22 of not more than $5,000, or both. In lieu of a fine, the court 1.23 may orderathe defendantconvicted under this subdivisionto 1.24 pay restitution to theaffected agencyowner to replace the 1.25 police dog, search and rescue dog, or arson dog, in an amount 2.1 not to exceed $5,000. 2.2 Subd. 2. [GROSS MISDEMEANOR.]WhoeverIt is a gross 2.3 misdemeanor for any person to intentionally and without 2.4 justificationcausescause substantial or great bodily harm to a 2.5 police dog, search and rescue dog, or an arson dog when the dog 2.6 is involved in law enforcement, fire, or correctional 2.7 investigation or apprehension, search and rescue duties, or the 2.8 dog is in the custody of or under the control of a peace 2.9 officer, a trained handler, or an employee of a correctional 2.10 facility, as defined in section 241.021, subdivision 1, clause2.11(5), is guilty of a gross misdemeanor. 2.12 Subd. 3. [DEFINITIONDEFINITIONS.] As used in this 2.13 section,: 2.14 (1) "arson dog" means a dog that has been certified as an 2.15 arson dog by a state fire or police agency or by an independent 2.16 testing laboratory; 2.17 (2) "correctional facility" has the meaning given in 2.18 section 241.021, subdivision 1, clause (5); 2.19 (3) "peace officer" has the meaning given in section 2.20 626.84, subdivision 1, paragraph (c); and 2.21 (4) "search and rescue dog" means a dog that is trained to 2.22 locate lost or missing persons, victims of natural or man-made 2.23 disasters, and human bodies. 2.24 Sec. 2. [EFFECTIVE DATE.] 2.25 Section 1 is effective August 1, 1999, and applies to 2.26 crimes committed on or after that date.
