3E Relating to human services

ARTICLE 1 - HEALTH CARE

Authorizing licensed
physicians, advanced practice nurses and licensed psychologists to make a
diagnosis and determination of attention deficit disorder (ADD) and attention
deficit hyperactivity disorder (ADHD) for the purpose of identifying a child
with a disability and eligible for and in need of special education instruction
and services; requiring the commissioner of health to modify regulations for
home care service providers to include certain home care aide tasks; "Grieving
Parents Act", requiring hospitals, clinics and medical facilities having custody
of a fetus following a miscarriage to provide written notification to the mother
of the right to arrange for the burial or cremation of the fetus; permitting
graduates of nonaccredited dental programs completing a clinical licensure
examination and meeting certain applicant requirements to be granted a limited
general dentist license by the board of dentistry; granting the commissioner of
human services the authority to join and participate as a member in a legal
entity developing and operating a statewide health information exchange;
modifying certain medical assistance (MA) provisions; modifying certain
eligibility requirements relating to homestead exclusions for individuals
residing in a long term care facility; providing home equity limits for medical
assistance (MA) payment of long term care services; clarifying asset
verification provisions; modifying certain form and statement requirements for
the treatment of annuities; expanding MA coverage for certain pregnant women;
providing for exchange of long term care partnership policy and addition of a
policy rider or endorsements under certain conditions; modifying eligibility for
the Minnesota partnership for long term care program; modifying application and
request requirements for MA eligibility; modifying medical assistance lien
provisions; authorizing the commissioner of human services to enter into certain
reciprocal agreements; modifying certain provisions relating to the treatment of
income and assets of an institutionalized spouse, defining continuous period of
institutionalization; modifying the payment of benefits from an annuity and
certain prohibited transfers of assets; creating a cause of action for certain
asset transfers, prescribing the process for filing cause of action; requiring
the health services policy committee to recommend criteria for centers of
excellence medical care aspects verification under certain conditions; modifying
the medical assistance preferred drug list; modifying certain pharmacist
medication therapy management services in ambulatory care settings and community
health worker requirements for medical assistance (MA) and general assistance
medical care (GAMC) coverages; revising requirements and procedures for county
based purchasing for state health care programs including general assistance
medical care (GAMC), medical assistance (MA) prepayment program and other
prepaid health care programs in counties administered by the commissioner of
human services, prohibiting contractual dispute mediation by a panel with
Minnesota council of health plans representation, requiring a contract
reprocurement or renewal schedule and a legislative report; modifying provisions
relating to MA prepayment demonstration project, expanding service delivery
requirements and modifying certain language assistance requirements to be
provided for enrollees with limited English language proficiency (LEP) by
demonstration providers; modifying dispute resolution mediation panel membership
requirements; modifying certain MinnesotaCare enrollment requirements for
general assistance medical care purposes; allowing certain claims against an
estate; clarifying certain duties of the commissioner of health relating to
county based purchasing for single-health plan managed care contracts; requiring
a commissioner of human services evaluation regarding the alternative payment
system reimbursement methodology for pension costs as a cause for nursing
facilities converting from public to private ownership funding shortfalls,
requiring a legislative report; requiring the commissioner of human services to
study and submit a report to the legislature by a certain date on reducing rate
disparities between nursing facilities in various regions of the state;
providing a revisor instruction; repealing the exchange for long term care
partnership policy addition of policy rider provision under the long term care
partnership program and certain provisions relating to the expiration of a
waiver of clinical examination for certain dentists and dental hygienists


ARTICLE 2 - MINNESOTA SEX OFFENDER PROGRAM

Providing for the classification
of data relating to the preparation of a petition to commit an individual as a
sexual psychopathic personality or sexually dangerous person; modifying the
Minnesota sex offender program to include housing court-hold ordered persons and
secure treatment facility or program residents; authorizing the commissioner of
human services to establish, equip, maintain and operate the Minnesota state
industries at any sex offender program facility, establishing a revolving fund
and providing for disbursements from the fund, authorizing commissioner to
borrow from the fund, providing for federal grant fund transfers, providing for
patient wages; allowing sex offender treatment participants committed to the
commissioner of corrections for incarceration and eligible for supervised
release to elect to remain confined in a state correctional facility, specifying
a process for election to continue confinement, specifying confinement terms,
providing for no right to treatment and authorizing the commissioner of
corrections to charge the county of financial responsibility for the costs of
confinement and requiring existing appropriations department use for
nonconfinement costs; providing for petitions for a reduction in custody of
persons committed as mentally ill and dangerous and civil commitments, providing
for appeal; requiring the commissioner to provide the judicial appeal panel with
victim information, privacy requirement; authorizing county attorney data access
in civil commitment proceedings; making conforming changes; requiring the
commissioner of human services (DHS) to convene an interested parties working
group to develop Minnesota sex offender program standards and guidelines,
specifying standards requirements

ARTICLE 3 - PUBLIC ASSISTANCE AND
LICENSING

Expanding commissioner of human services set aside licensure
variance
conditions to include the corrections field; eliminating certain
commissioner of human services federal fiscal allowances for the foster care
program; modifying the Minnesota family investment program (MFIP) eligibility
provisions by clarifying licensed multiple vehicle loan value county agency
determination; increasing the transitional standard and food portions; requiring
employment plans or family stabilization services plan development and
compliance for hardship extension categories eligibility maintenance; modifying
the definition of work activity and specifying certain county notification
requirements to participants in unpaid work experience; eliminating the
self-employment investment demonstration program (SEID) from the definition of
work activity and self employment activities; requiring educational plan school
consultation; modifying family violence claim documentation requirements;
prohibiting a county or tribe from imposing a residency requirement on families,
exception, changing the MFIP funding performance base to be based on county or
tribal temporary assistance for needy families (TANF) participation rate;
clarifying diversionary work program (DWP) eligibility; modifying the effective
date for the expiration of food support benefits;
