E Relating to civil law ARTICLE 1 � TRUSTSModifying certain provisions of the
trust law; providing for the +creation and termination of memorial fund trusts,
providing for the addition of +funds to trusts established for the benefit of
one or more individuals with a +single transfer, subjecting memorial fund trusts
to the Minnesota uniform +custodial trust act; providing for the transfer of
additional funds; creating a presumption of corporate trustee mandatory
replacement upon district +court appointment of a successor trustee, exception;
removing a certain +exemption from the prohibition against the exercise of
certain powers by +trustees for certain trusts created before a certain date;
authorizing and +providing for trustees and beneficiaries of trusts not under
court supervision to +enter into binding nonjudicial settlement agreements
relating to certain +specified matters, providing for validity and specifying
certain notice +requirements; expanding the authority of the court to remove
trustees; providing an+ effective date for certain prior amendments to a certain
provision providing +for the revocation of wills by marriage dissolution ARTICLE
2 � GUARDIANS AND CONSERVATORS Modifying certain provisions regulating
guardians and conservators +under the uniform probate code relating to the
transfer of money or personal +property to a minor under powers of attorney
delegations; making optional the +requirement for the court to appoint a
visitor upon receipt of a petition to +establish a guardianship or
conservatorship and eliminating the visitor +qualification requirement;
requiring guardian notice to the court of the filing of +reports; expanding the
list of appealable orders; making certain technical +corrections ARTICLE 3 �
TECHNICAL CORRECTIONSMaking technical corrections to certain provisions
providing for the +duties of guardians and conservators under certain provisions
regulating the +performance of abortions on unemancipated minors, living wills,
health care +directives, the suspension or revocation of licenses or
registrations of certain +health care professionals, the payment of workers
compensation to injured +employees, estates of veterans, protection of persons
with mental retardation +and related conditions, the treatment of persons under
civil commitment, the +eligibility of pregnant minors for the Minnesota family
investment program (MFIP), +the designation of standby and de facto custodians,
the protection of +children under juvenile court jurisdiction, trusts, the
rights and privileges +of married persons, powers of attorney, certain probate
proceedings and the +treatment of vulnerable adults by caretakers; specifying
certain reference change instructions to the revisor of statutes (ra, ja)
