1E Requiring the commissioner of human services (DHS) to manage home and
community-based waiver allocations to fully use available waiver funding and
requiring remaining balance to be contributed to the allowed reserve account;
requiring the commissioner to issue annual reports on county and state use of
available resources for the home and community-based waiver services for persons
with developmental disabilities; requiring the commissioner to consider exiguous
spending when evaluating a corrective action plan; making county and tribal
agencies responsible for spending commissioner allocations; establishing a home
and community-based waiver services reserve account for county and tribal
agencies and providing for contributions, distributions, reporting,
non-cancellation, and transfer; modifying rate stabilization adjustment by
defining and adding a rate adjustment moratorium period; requiring the
commissioner to train county personnel; modifying staffing policy; changing day
program payments and payments for unit-based services with programming and
values for the facility use rate in day services; requiring the commissioner to
develop person-centered staffing environments; modifying the exception request
process; modifying the budget neutrality adjustments
