hf329 ARTICLE 1 DEATH PENALTY Section 1: notice by state in death penalty cases
required. Sec. 2: guidelines provided for appointment of public defense
attorneys. Sec. 3: sentencing proceedings for death sentence for first degree
murder provided; cases defined in which sentence other than that of death shall
be imposed; separate sentencing proceeding procedures provided; aggravating
circumstances defined; mitigating circumstances defined. Sec. 4: imposition of
death sentence and mode of execution conditions provided; evidence of
aggravating and mitigating circumstances defined; situations provided in which
death sentence is precluded; mode of execution by lethal injection defined. Sec.
5: sentencing court administrative requirements relating to execution date,
copies of order of execution, and delivery of defendant to maximum-security
prison provided. Sec. 6: automatic review of death sentences by Supreme Court
guidelines provided. Sec. 7: procedures provided for unified review of all
possible challenges to the trial, sentence, and detention of defendants upon
whom the death sentence has been imposed. Sec. 8: conditions defined in which
execution of death may be stayed; procedures for determining such conditions
provided. Sec. 9: governor's duties in issuance of death warrant provided. Sec.
10: procedure for enacting death penalty detailed; warrant of execution issued
by governor; duties of supreme court as pertains to executions. Sec. 11:
reimbursement guidelines for cost of execution provided. Sec 12: appropriations
defined. Sec 13: effective date of sections 1 to 11 defined as August 1,
2001.ARTICLE 2 TECHNICAL AMENDMENTS Sec. 1: Minnesota Statutes amended to
prevent a person sentenced to death from being paroled. Sec. 2: Minnesota
Statutes amended to include death sentence on list of possible punishments for
conviction of a felony. Sec. 3: Minnesota Statutes amended to prevent a person
sentenced to death from becoming eligible for supervised release or discharge.
Sec. 4: Minnesota Statutes amended to change references to "life imprisonment"
to "life sentence" or "sentence of death." Sec. 5: Minnesota Statutes amended to
reflect addition of death sentence to possible punishment for those guilty of
murder in the first degree. Sec. 6: effective date for sections 1 to 5 defined
as August 1, 2001.
